Inspector Notes

An unannounced, on-site monitoring inspection was initiated on 6/6/2024 and completed on 7/23/2024, as a part of a self reported incident that occurred on 5/17/2024. The on-site inspection began at 3:10 on 6/6/2024 and footage of the school video was viewed on 7/23/2024 at 10:15am. The inspector reviewed compliance in the areas listed above. The inspector reviewed 1 child?s record and 1 staff record on-site and a staff handbook electronically. This inspection included (include all that apply from the list below).

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Standard 8VAC20-780-40-E
Based on review, the facility did not ensure that staff followed their policy on discipline, that is required by these standards.
Evidence: reviewed the facility's policy on discipline and found that staff had roughly handled Child 1, by pulling on their hoodie, and pulling on their wrist, and did not follow the facility's policy on discipline.

Standard 8VAC20-780-400-B
Based on interviews and video footage, the facility did not ensure that behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.
Evidence: identified through staff interview and video footage provided by the school that Child 1 had taken the radio from Staff 1, and after several attempts to retrieve it, the child kept the radio away. The staff member pulled the back of the child's hoodie with their left hand, causing the child to fall along the stools of the lunch table, and with the other hand the staff member then grabbed the child by the wrist, pulled the radio out of the child's hand, causing the child to fall head first onto the ground. The child then sat on the floor as the teacher walked away. The child then walked over to another teacher to explain what had just happened. Staff 1 followed the child and told the child "not to lie" about the incident.

Based on interviews and video footage, forbidden actions were observed on 5/17/2024.
Evidence: observed in video footage provided by the school, Staff 1 grabbed Child 1 by the hoodie, pulling them hard enough to cause the child to fall to the side, on top of the benches at the lunch table, then pulled the child's arm hard enough to cause the child to fall head first to the ground.
