During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.
Inspector Notes
An unannounced inspection was initiated on 04/15/2025 and completed on 04/29/2025 with a local agency, in response to a complaint received by the licensing office on 04/14/2025 relating to Special Care Provisions and Emergencies. The inspector reviewed 1 child?s record and 3 staff records onsite. This inspection included document review, tour of the facility, and interviews.
The preponderance of evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. Information gathered during the inspection determined non- compliance with applicable standards or law, and the violations are documented on the violation notice issued to the program. Though not a part of the original complaint, violations that were not reported were found related to medication policies and are documented on the violation notice issued to the program.
Violations
4On 4/09/2025, Child #1(age 20 months old) was observed being ?lethargic, sleepy, and pale?, Staff #1 contacted the child?s parent at 8:10am to report the concerns.
At 8:22am, Staff #2 brought Child #1 to the lobby after observing Child#1?s lips had turned ?blue?.
Staff #2 spoke to Child #1?s parents on the phone multiple times to provide updates regarding Child #1?s condition while one parent was on their way to the center.
At 8:39am, Child #1?s parent requested Staff #2 to call 911 so that Child #1 could receive emergency care. Staff #2 informed the child?s parent that 911 would not be called. Upon the center?s refusal, the parent called 911.
At 8:48am, Staff #2 observed Child #1 ?take a gasp of breath and then the child?s chest caved in?.
Staff #2 then called 911 who reported an ambulance had already been dispatched to the location at the request of the parent.
All center staff will be retrained on center emergency plan and response procedures.
Monthly Emergency drills will be conducted.
The center?s procedures for action in case of ill or injured children and medical emergencies states: ?In the event of a serious accident or illness, an ambulance will be called?.
On 4/9/2025, Child #1 was observed to be ?pale, lethargic?, with ?blue lips?.
Child #1?s parents requested the center call 911 after learning of Child #1?s symptoms. The center denied the parent?s request to call 911.
All center staff will be retrained on center emergency plan and response procedures.
Monthly emergency drills will be conducted.
Medication for Child #1 was not picked up by the parent, the authorization and the medication was not disposed of by the center. The medication was onsite for 5 months after the authorization expired.
On 4/9/2025, Child #1 was transported to the hospital by ambulance after experiencing blue lips, a gasp for breath, and concaved chest. The center did not notify the department of the incident.
