22.1 Background Checks Code, Carbon Monoxide
During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.
Inspector Notes
An unannounced inspection was initiated on 9/23/2024 and completed on 10/28/2024 in response to a complaint received by the licensing office on 9/10/2024 relating to allegations of forbidden actions, background checks, and care, protection and guidance. The inspector reviewed 1 child?s record on-site. This inspection included document review, tour of the facility, interviews, and observations.
The preponderance of evidence gathered during the investigation supports the allegations; therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.
Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 1/14/2025. A POC submitted after this date will not appear on the public website.
Violations
4Staff #1 was employed at the center for over 10 months and did not have documentation on file of a central registry search request or results.
On 8/15/2024, Staff #2 restrained Child #1 (Age 3) by holding them in their lap and holding their arms to their chest due to the child's behavior while Staff #2 stated "I need you to stop, you can't do that". This behavioral guidance is not constructive in nature and was not intended to redirect the child to appropriate behavior.
On 8/15/24, Staff #2 tightly held Child #1 (Age 3) in their arms, restricting the child's movement by holding their arms to their chest for at least 30 seconds. Child #1 made numerous attempts to get down including trying to push staff's arms away and to wiggle out of Staff #2's arms.
On 8/19/2024, Child #1 sustained an injury at the center and there was no written injury report completed. Child #1 had a red abrasion mark that extended from the front to back of the child's neck.
