During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Inspector Notes

An unannounced inspection was initiated and completed on 12/16/2024 in response to a complaint received by the licensing office on 12/11/2024 relating to allegations of ratio, behavioral guidance, group assignment, and care, protection and guidance. The inspector reviewed 3 children?s records on-site. This inspection included document review, tour of the facility, interviews, and observations. The preponderance of evidence gathered during the investigation supports the allegations; therefore, the complaint is determined to be valid. Though not a part of the original complaint, violations that were not reported were found related to nutrition and administration and are documented on the violation notice issued to the program. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.

Repeat Violation

The center is required to obtain documentation of a physical examination for each child within 30 days of child's first day of attendance.

Child #5 has been enrolled at the center for over one year and eight months and did not have a physical examination on file.

Standard 8VAC20-780-340-A
Staff shall always ensure children's care, protection, and guidance.

Child #5 is listed on the classroom's written allergy and sensitivity list as not to be served dairy. Child #5 was served cheese ravioli during lunch time. The staff responsible for preparing the meal and bringing food to classrooms was unaware of children's allergies and dietary sensitivities.

Standard 8VAC20-780-350-Q
Centers shall not casually or repeatedly disrupt a child's schedule and attachment to their staff members and group by assigning them to a different age group for reasons of administrative necessity.

On 12/16/2024, Child #1 (Age 2) was in the Toddler room, though the child's assigned age group is the Twos. Child #1 is regularly placed in the Toddler room multiple times per week due to ratio. Child #2 (Age 3) was in the Twos room, though the child's assigned age group is the Threes/Preschool. Child #2 is regularly placed in the Twos room multiple times per week due to ratio and because Staff #1 is "good with him". Child #3 (Age 2) had to be moved to the Toddler room for a period of time due to the Twos class being over ratio.

Repeat Violation

Behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.

On 12/16/2024, Staff #1 instructed Child #4 to go wash hands at the sink before lunch. Child #4 did not go to the sink and instead stayed standing at the table. Staff #1 then grabbed Child #4 by both upper arms lifting the child off the ground and carried the child approximately 7 feet away to the carpeted area and laid the child down on the ground. Staff #1 stated that Child #4 will occasionally thrash around on the floor when having a tantrum and this was done to prevent injury to the child.

When centers choose to provide meals or snacks, a menu listing foods to be served for meals and snacks during the current one-week period shall be dated, posted in a conspicuous location to parents or given to parents, list any substituted food and be kept on file for one week at the center.
