Inspector Notes

An unannounced code compliance inspection was conducted on 09/13/2023 from 10:05 AM to 11:35 AM. There were 41 children present, ranging in ages from five months to four years old, with 11 staff. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, procedures and medication. A total of five children?s records and five staff records were reviewed.

Information gathered during the inspection determined non-compliance to applicable standards or law and violations were documented on the violation notice issued to the facility.

Standard 22.1-289.031-A
Based on observations and interview, the center failed to post the fact that the center is exempt from licensure in a visible location on the premises.
Evidence:
1. A tour of the facility was conducted. No posting stating the center?s exemption was found.
2. The director confirmed that the center?s exemption was not posted.
Plan of Correction: Letter of exemption is posted along with other required documents in the school hallway.
Standard 22.1-289.031-A-9
Based on observation, the center failed to comply with safe sleep guideline by the American Academy of Pediatrics.
Evidence:
1. In the infant room, there was one child (five months old) who was observed sleeping in a bouncy seat.
2. Staff #2 confirmed the child was five months old.
Plan of Correction: The sleeping arrangement in question was fixed immediately. Safe sleep guidelines were reviewed with both staff and parents. Moving forward all sleeping has been done as recommended.

Based on observation and review of records, the center failed to repeat background checks every five years.
Evidence:
1. Staff #1?s criminal history background check was date 05/04/2018.
2. Staff #2 confirmed that there was not an updated background check for Staff #1.
Plan of Correction: All background checks were updated, a review of all employee files took place.

Based on review of records and interview, the center failed to obtain a Criminal History Background Check on all employees before the first of day employment.
Evidence:
1. Staff #2?s first day of employment was July of 2020. Staff #2 confirmed that there was no Criminal History Background check in their file.
Plan of Correction: All background checks were updated, a review of all employee files took place.
Standard 22.1-289.036-B-4
Based on review of records and interview, the center failed to complete out of state background checks for staff who had lived out of state within the past five years.
Evidence:
1. Staff # 5 indicated on their sworn statement that they had lived in Pennsylvania within the last five years. There were no out of state background checks on file for Staff #5.
2. Staff #2 confirmed that the out of state background checks had not been conducted for Staff #5.
Plan of Correction: All background checks were updated, a review of all employee files took place.
Standard 8VAC20-770-40-D-2
Based on review of records, the center failed to receive a Central Registry Background Check for each employee by the end of the 30th day of employment and the center failed to obtain a Sworn Statement prior to the first day of employment.
Evidence:
1. Staff #2?s first day of employment July of 2020. Staff #2 confirmed that there was no Central Registry Background Check or Sworn Statement in their file.
Plan of Correction: All background checks were updated, a review of all employee files took place.
