During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Inspector Notes

An unannounced inspection was initiated on September 2, 2025, and completed on September 23, 2025, in response to a complaint received by the licensing office on August 29, 2025, relating to allegations of Staffing and Supervision and Programs. The Department issued a Special Order to require the licensee to contact parents, guardians, or other responsible persons regarding health and safety violations on August 26, 2025, as a result of high-risk violations. The inspector reviewed 1 child record and 0 staff records on-site. This inspection included document review, tour of the facility, interviews and observations.

The preponderance of evidence gathered during the investigation supports the allegations; therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on September 30, 2025. A POC submitted after this date will not appear on the public website.

Standard 8VAC20-780-340-A
COMPLAINT RELATED, REPEAT VIOLATION and SYSTEMIC DEFICIENCY

When staff are supervising children, they shall always ensure their care, protection, and guidance.

On August 29, 2025, Child #1 (age 3) was sitting on their cot and got up off of their cot, put their blanket away and went to go sit in a chair at a classroom table. While Child #1 was sitting at the table, staff #1 entered the classroom and roughly snatched Child #1 out of their chair from behind. Child #2 (age 3) was laying down on their nap cot when Staff #1 walked over and kicked one side of the cot up three times before the child rolled off on to the floor.
Plan of Correction: Staff were retrained on Virginia licensing regulation and positive guidance/supervision procedure in a staff meeting that took place on September 23,2026. Staff will also be assigned learnings by 10/3/25 for Positive Guidance and Positive Behavior Support and required to complete them by 10/31/25. School administrator and support management will also observe classrooms weekly to ensure teachers are following regulation and provide coaching and development in the moment. Staff member involved is no longer employed with the company.

COMPLAINT RELATED, REPEAT VIOLATION and SYSTEMIC DEFICIENCY

The following actions or threats thereof are forbidden: roughly handling a child.

On August 29, 2025, Staff #1 roughly snatched Child #1 (age 3) out of a chair from behind. Staff #1 used their foot to kick up Child #2 (age 3) nap cot from one side, the staff kicked the cot up three times before the child rolled off on to the floor.
