During the inspection, the inspector reviewed the areas listed above. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be

Inspector Notes

An unannounced monitoring inspection was initiated on September 24, 2024 and completed on October 2, 2024 relating to a self-report received by the licensing office on September 23, 2024 relating to behavior guidance and forbidden actions. The inspector reviewed 5 children's records and 4 staff records on-site. This inspection included document review, tour of the facility, and interviews.

Though not a part of the original self report, violations that were not reported were found related to administration, background checks, and staff training and are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on October 11, 2024. A POC submitted after this date will not appear on the public website.

Standard 22.1-289.035-B-1
The center is required to obtain a completed sworn statement prior to the employee's first day of employment.

The sworn statement for Staff #2 , who is currently working, is dated one week after their first day of employment.

Providers must obtain a completed national criminal background check prior to the employee's first day of employment.

Staff #1, who had been employed for three (3) weeks, did not have a completed national criminal background check prior to employment. The national criminal background check for Staff #2 , who is currently working, was dated two (2) weeks after their first day of employment.

The center is required to obtain a copy of background checks from any state in which the individual has resided in the preceding five years.

Staff #1, employed for 3 weeks, did not have documentation of requesting an out-of-state central registry check and a sex offender registry search.

Standard 8VAC20-780-130-A
The center shall obtain documentation that each child has received the immunizations required by the State Board of Health before the child can attend the center.

Child #3, #4 and #5, who had been attending for 3 weeks, did not have documentation of an immunization record on file.

Repeat Violation
Plan of Correction: Management will work with family to get an updated immunization record no later than October 24th. Moving forward management will ensure all file items (including immunizations) are on site before a child's 1st day of attendance. Additionally, management will complete monthly checks of immunizations to ensure we have updates on file every 6 months.
Standard 8VAC20-780-160-A
Documentation of a negative tuberculosis (TB) screening must be submitted at the time of employment, before coming into contact with children, and shall have been completed within the last 30 days of the date of employment.

Staff #1 TB was dated two months prior to the date of employment, and Staff #2 had no documentation of a TB screening and has been working for 3 weeks.
Plan of Correction: Moving forward management will ensure all file items (including TB tests) are on file before an employee's 1st day of employment. Additionally, management will complete monthly file checks for any updated file items needed to ensure compliance.

Staff shall complete orientation training prior to the staff member working alone with children and no later than seven days of the date of assuming job responsibilities.

Staff #1 and Staff #2, who have been working with children for 3 weeks, did not have documentation of orientation training to include all of the facility's specific topics.

Standard 8VAC20-780-60-A
Each center shall maintain and keep at the center a separate record for each child enrolled that contains all of the required information.

Child #1, #2, #3, #4, and #5 and 16 other children did not have records for this center. The children had been attending for 3 weeks and their records were for a different child care center.

Each center shall keep and maintain staff records for each staff person.

Staff #1 and Staff #2, who has been actively working at the center for the last 3 weeks, did not have a staff record with the required documents. The records did not have an application, date of employment, references, background checks, documentation to demonstrate the individual possesses the education, certification and experience required for the job position, and health information.

Standard 8VAC20-780-90-A
A written agreement between the parent and the center shall be in each child's record by the first day of the child's attendance. The agreement shall be signed by the parent and include an authorization for emergency medical care, a statement the center will notify the parent when the child becomes ill and parent will arrange to have the child picked up, and a statement that the parent will inform the center within 24 hours or the next business day after his child or any member of the immediate household has developed any reportable communicable disease.

Child #1, #2, #3, #4, and #5 did not have written parental agreements for the center. The parental agreements were for a different child care program. There were 16 other children in attendance from a different center who did not have parental agreements.
