Inspector Notes

A monitoring inspection was conducted on 1/19/2024, in response to a complaint that was received by the department regarding allegations in the area of behavior guidance and forbidden actions. The inspector was onsite from approximately 11:00 AM until 12:10 PM. Interviews with staff were conducted on-site, video footage, as well as documentation related to the incident were also reviewed.

The preponderance of the evidence gathered during the investigation supports the allegation, therefore the complaint is determined to be valid. See the violation notice for more details.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Based on a review of the center Parent Handbook policies and Policy and Procedures, the center failed to follow their established disciplinary policy of positive guidance and redirection.

Evidence:
1. When Child #1 was fighting with another child in their classroom, staff did not use positive guidance or redirection prior to moving child #1 as a disciplinary measure.

Standard 8VAC20-780-400-B
Based on video observation, behavioral guidance was not constructive in nature, age, and stage appropriate, and intended to redirect children to appropriate behaviors.

Evidence:
1. On 01/08/2024, at approximately 10:00am, in response to Child #1 (4-year-old) hitting and pushing child #2 (4-year-old). Staff #1 lifted Child #1 by the left arm and pulled them from a seated position on the floor to a standing position and placed Child #1 on another area of the carpet. Child #1 was not seen crying in the video but looked upset. Staff #1 walked away from Child #1 without attempting to comfort or talk to child #1.
