Inspector Notes
A complaint inspection was conducted on October 27, 2023, in response to a complaint that was received by the department on October 12, 2023, regarding the concerns of staff background checks and ratios in the classrooms. Staff were interviewed, and documentation was reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. The complaint is determined to be valid for lack of background checks on staff members. The violation was discussed with the provider at the time of the exit interview. The center is given ten business days to provide the appropriate background checks to licensing.
Violations
3Evidence:
1. Staff #2 (date of hire 06/20/2023) was present at the center working with children. Staff #2 did not have documentation that the criminal checks were completed in their file.
2. Staff #5 (date of hire 05/04/2023) did not have documentation that the criminal checks were completed in their file.
3. Staff #1 confirmed that Staff #2 and Staff #5 were hired prior to obtaining results of a criminal history check and were working with children without a criminal history record check at the daycare.
Evidence:
1. Staff #3 (date of hire 10/23/2023) reported on their Sworn Statement Disclosure dated 10/23/2023, that they lived in another state outside of Virginia in the past five years.
2. Staff #3 was present at the center caring for children without an out of state background check completed.
3. Staff #1 confirmed that there was no out-of-state background check completed on Staff #3 and that they were currently at the center working with children.
Evidence:
1. Staff #4 (date of hire 05/08/2023) did not have the central registry results completed and there is no documented in their record that it was requested.
2. Staff #1, the director, confirmed that there the Virginia Central Registry results were not completed by the end of the 30th day of employment for Staff #4.
