Inspector Notes

This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program.

A monitoring inspection was conducted on January 20, 2022. There were 36 children present and in the care of 6 staff. The inspector reviewed compliance in the areas of administration, physical plant, staff qualifications, staffing and supervision, physical plant, programming, special services, special care provisions and emergencies. A total of 5 children's records were reviewed. The complete records were reviewed for five new staff and partial records were reviewed for an additional 9 new staff.

Information gathered during the inspection determined non-compliances with applicable standards or law and the violations were documented on the violation notice issued to the program.

Standard 22.1-289.035-B-4
Based on review of staff records and verification from the director, the center failed to obtain all of the required out-of-state background checks in the required timeframe for one staff member who had lived outside of Virginia within the last five years.

Evidence:
1. The record for new Staff Member #13 contained an out-of state criminal history record check which was not dated before the date of hire. The check was completed and dated 11/03/2021 and the date of hire was 08/30/2021.
2. The record for new Staff Member #13 contained an out-of state sex offender check which was not dated before the date of hire. The check was completed and dated 09/01/2021 and the date of hire was 08/30/2021.
3. The record for new Staff Member #13 did not contain an out-of-state search of the child abuse and neglect registry. Date of hire for Staff Member #13 was 08/30/2021.
4. The director confirmed that one out-of-state background check had not been obtained and two had been obtained after the date of hire.
Plan of Correction: Proof was sent to the licensing inspector that the child abuse and neglect search was requested on 01/20/2022. The check was completed on 01/21/2022. The staff now understand when all out-of-state background checks must be obtained.
Standard 8VAC20-780-130-A
Based on review of children's records and discussion with the director, the center did not obtain one child's immunization record before the date of enrollment.

Evidence:
1. The record for Child #1 contained an immunization record which was dated 12/06/2021. The date of enrollment for Child #1 was 06/16/2021.
2. The director confirmed the immunizations were obtained late.
Plan of Correction: All immunization records will be obtained by the first day of enrollment.
Standard 8VAC20-780-140-B
Based on review of children's records and confirmation from the director, the center failed to ensure that the physical examination report for one child had been completed within the required time period.

Evidence:
1. The record for Child #2 contained a physical examination report dated 08/21/2020 which was more than a year old at the time of enrollment. The date of birth of the child was 02/03/2017 and the date of enrollment for the child was 12/10/2021.
2. The director confirmed that the physical examination had been completed more than one year before the child enrolled.
Plan of Correction: A current physical examination report will be obtained before Child #2 can return.
Standard 8VAC20-780-40-G
Based on review of children's records and verification from the director, the center did not obtain proof of one child's identity and age.

Evidence:
1. The record for Child #2 did not contain documented proof of the child's age and identity. The date of birth for Child #2 was 02/03/2017 and date of enrollment was 12/10/2021..
2. The director confirmed there was no proof of birth in the child's record.
Plan of Correction: Proof of identity will be obtained before the child can return. In the future, if proof of identity and age have not been obtained within seven days of enrollment, the center will contact the local authorities.
