8VAC20-780 Staffing and Supervision

Inspector Notes

An investigation in response to a self-reported incident was initiated on 04/17/2023 and concluded on 04/20/2023. An onsite visit was conducted on 04/19/2023 between the hours of approximately 3:10 p.m. and 3:50 p.m. Interviews were conducted, records were reviewed and observations were made. After carefully interviewing all involved parties, information gathered determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Standard 8VAC20-780-340-F
Based on staff interview, a child under 10 years of age was not within actual sight and sound supervision of staff at all times.

Evidence:
1. Staff #2 stated that on 04/13/2023, they went inside with a group of three children, leaving Staff #1 outside with the remaining kids.
2. Staff #1 stated that they were playing Four Square with a group of children, when Child #1 (age: 5 years) and Child #2 (age: 6 years) asked to go to the playground. When the game was over, at approximately 4:50 p.m., Staff #1 gathered the group of children playing Four Square and went inside. They stated that they did not do a headcount.
3. Child #1 and Child #2 remained on the playground, unsupervised.
4. Staff #1 stated that approximately five minutes after going inside, Child #1?s parent arrived to pick up the child. When the parent asked where Child #1 was, Staff #1 realized that the children were still outside and went to retrieve Child #1 and Child #2 from the playground. Both children were still playing.
Plan of Correction: Reinforced with staff that there must always be two staff member in the care of our Junior Kindergarten/Kindergarten group. At the time of violation, they had split into two groups, leaving only staff member #1 with a group outside.

Staff had been relying on School Pass app for attendance. Junior Kindergarten/Kindergarten group will now also carry a paper attendance tracker to keep number of students in care visually present.
