Inspector Notes
An unannounced Code Compliance inspection was conducted today with the Administrator from 11:15 am to 11:55 am. There were twenty children present with seven staff providing supervision. The ages of the children ranged from 3 months to 4 years. By the end of the inspection the preschoolers were having lunch. Seven staff and six children's files were reviewed during this inspection. The area of non compliance is outlined on the violation notice.

Based on a review of seven staff files and interview with the Administrative staff, it was determined that there have been no out of state background checks to include sex offender registry, child abuse and neglect registry and criminal history report from a state an employee resided in the preceding five years.
Evidence:
Staff A was hired in September 2019 and had lived in New Mexico the preceding five years. There was no sex offender name search, child abuse and neglect search or criminal record search on file for this staff. The sex offender name search and criminal background check are required prior to employment and the child abuse and neglect search must be requested within 30 days of employment.

Plan of Correction: We obtain the sex offender name search on 5/9/23 and we are in the process of requesting the two additional out of state background checks.
