Inspector Notes

A monitoring inspection was initiated and concluded on 12/16/2022. There were 15 children present, ranging in ages from 5 to 9 years old, with 2 staff supervising. The inspector reviewed compliance in the areas of Religious Exempt; Background Checks Code; Carbon Monoxide, Child Abuse and Neglect, Mandated Reporting, and Medication Training. A total of 5 staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Based on a review of records, the exempt program did not ensure that, for each staff person, their a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years is present in their record.

Evidence:
Five staff records were reviewed.
The record for staff #5 (hired September 2021), contained a Sworn Disclosure Statement that indicated that staff #5 lived in Maryland within the previous five year period.
The record for staff #5 did not contain a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from Maryland.
The staff person on charge at the time of inspection was unable to locate this documentation.
Plan of Correction: The program director will request that a Search of the Central Registry and Search of the Sex Offender Registry for Maryland be completed within 10 business days from receipt of the violation notice dated 12/22/2022. The results will be placed in the employee's record and a copy forwarded to the inspector for review.

Based on a review of records, the exempt program did not ensure that for each staff person, a copy of the results of a search of the Central Registry was obtained within 30 days of employment or commencement of service.

Evidence:
Five staff records were reviewed.
The record for staff #1, whose hire date was September 2021, did not contain results of a Virginia Search of the Central Registry.
The staff person in charge at the time of the inspection was unable to locate the results, but was able to produce a copy of the documentation that she stated had been mailed out at the time of hire.
Plan of Correction: The program director will contact the Office of Background Information to inquire about the results and will request that a new Search of the Central Registry be completed, if advised to do so, within 10 business days from receipt of the violation notice dated 12/22/2022.
The results will be placed in the employee's record and a copy forwarded to the inspector for review.
