Inspector Notes

An unannounced monitoring inspection was conducted on 12/7/2023 from 11:00am-12:15pm.
At the time of entrance, 62 children were in care with 11 staff members present. The sample size consisted of 10 staff records. Children were observed watching a Holiday Program in the sanctuary, eating an afternoon snack, participating in activities and transitioning for pick up by families. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program Repeat violations were found and are identified within this report.

Based on a review of records, the exempt program did not ensure that, for each staff person, a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years is present in their record.

Evidence:
10 staff records were reviewed. The record for staff #7, contained a Sworn Disclosure Statement dated 9/20/2022 that indicated that staff #7 resided in California within the previous five year period. The record for staff #7 did not contain a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from California.

The record for staff #9 contained a Sworn Disclosure Statement dated 8/22/2023 that indicated that staff #9 resided in Texas within the previous five year period. The record for staff #9 did not contain a sex offender registry check, and a criminal record from Texas.

The record for staff #10, contained a Sworn Disclosure Statement dated 9/20/2022 that indicated that staff #10 resided in Georgia within the previous five year period. The record for staff #10 did not contain a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from Georgia.

The interim director was unable to locate these background check documents during the inspection and confirmed that they were not in the staff records.
