During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Inspector Notes

An unannounced, on-site code compliance inspection was initiated on 12/13/2024 and completed on 12/29/2024. The on-site inspection began at 2:40 pm and ended at 4:25 pm. The inspector reviewed compliance in the areas listed above.

There were 5 children present with 2 staff. The inspector reviewed 5 children?s records and 5 staff records on site. This inspection included document review, tour of the facility, interviews, observations and measurements.

Information gathered during the inspection determined non-compliance(s) with applicable code sections, and violations are documented on the violation notice issued to the program.

Standard 22.1-289.035-B-4
(Repeat Violation) The center is required to obtain background checks from any state in which the individual has resided in the preceding five years. The center did not request a search of the Sex Offender registry from one state for Staff #4, who has been employed for more than 3 months and was working with children at the time of the inspection.
Plan of Correction: This was an oversight due to the fact that the state where staff #4 resided was a closed state and would not provide results of the Criminal Record Check or Abuse and Neglect Registry Search to the program.

The program was not aware that a search of the Sex Offender website could be completed independently. Immediate attention was given to complete the background check via the Sex Offender website. This was attempted on 12/13/24, 12/16/24, and 12/17/24 with a response of "The following jurisdiction(s)... are temporarily unavailable. Please try again later."
When attempted on 12/18/24, results were provided with "no data available in table." Staff #4's out of state search of the Sex Offender Registry results were provided to the inspector on 12/18/2024.
