Inspector Notes

An unannounced code compliance inspection for the religiously exempt child day center was conducted on 02/26/2024. There were a total of 46 children, ages 2 years-5 years and 9 staff present during the inspection. A total of 5 children?s records and 5 staff records, as well as other required documents were reviewed during the inspection. The children were observed participating in learning activities, in free choice play and going outside for large motor play. The inspector discussed the following: background check requirements, record requirements, and training opportunities. The inspector arrived at 8:50 am and departed at 10:30 am.

Information gathered during the inspection determined non-compliance with the Code of Virginia and violations were documented on the violation notice issued to the provider.

Based on observations, the center failed to ensure that the fact that the center has posted the fact that it is exempt from licensure in a visible location on the premises.

Evidence: There was not an exemption status notice posted on the premises.

Standard 22.1-289.031-A-3-c
Based on observation and record review, the center failed to maintain the required staff-to-child ratio whenever children are in care.

Evidence: During the 02/26/2024 inspection, a total of 9 children and 1 staff member were observed in 2 year old class. The required staff-to-child ratio for children 24 months- 36 months is 1:8. Two staff would be required for this group of children.
Plan of Correction: Will make the necessary adjustment to meet the ratio.
Standard 22.1-289.035-A
Based on record review, the provider failed to ensure that all caregivers shall undergo a background check in accordance with the Code of Virginia prior to employment and every five years thereafter.

Evidence:
1. The most recent sworn statement in the record for Staff 1 was dated 02/07/2019; the sworn statement for Staff 1 was not updated by 02/07/2024 as required.
2. The most recent sworn statement in the record for Staff 4 was dated 02/06/2019; the sworn statement for Staff 4 was not updated by 02/06/2024 as required.
3. The most recent criminal record check (fingerprint employment eligibility letter) in the record for Staff 1 was dated 03/09/2018; the criminal record check for Staff 1 was not updated by 03/09/2023 as required.
4. The most recent criminal record check (fingerprint employment eligibility letter) in the record for Staff 4 was dated 03/19/2018; the criminal record check for Staff 4 was not updated by 03/19/2023 as required.
Plan of Correction: Will request the new information.

Based on document review and staff interviews, the center failed to ensure that no person shall be hired for compensated employment prior to the facility obtaining an employment eligibility letter upon the completion of a fingerprint background check as required by the Code of Virginia.

Evidence:
1. Staff 6 stated that Staff 2 was hired on 09/27/2022. There was not an employment eligibility letter for Staff 2 available for review during the inspection. Staff 2 was observed working during the inspection.
2. Staff 6 stated that Staff 3 was hired on 09/28/2022. There was not an employment eligibility letter for Staff 3 available for review during the inspection. Staff 3 was observed working during the inspection.
3. Staff 6 stated that Staff 5 was hired on 09/20/2023. There was not an employment eligibility letter for Staff 5 available for review during the inspection. Staff 5 was observed working during the inspection.
Plan of Correction: Will check with the church office and if they do not have a copy will request new ones.
