Inspector Notes

An unannounced code compliance inspection was conducted on 04/09/2024 from 10:14 AM to 11:30 AM. There were 63 children present, ranging in ages from 20 months to five years, with 14 staff. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, and procedures. A total of six children?s records and six staff?s records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Based on record review and interview, the center failed to update sworn disclosure statements every 5 years.

Evidence:

The most recent sworn disclosure statement for staff 1 is dated 9/8/17.
The most recent sworn disclosure statements for staff 2 and staff 3 are dated 9/7/17.
Plan of Correction: Two of the sworn disclosure statements were completed by the staff during the inspection. The third staff will be required to complete the sworn statement before the end of the week. In the future the director will ensure sworn statements are updated every five years.

Based on record review and interview, the center failed to request a search of central registry background check within the first 30 days of employment, a search of sex offender registry prior to the first day of employment, and a criminal history name check prior to the first day of employment for any state in which a staff member resided in the preceding five years.

Evidence:

1. The sworn disclosure statement for staff 5 documents staff 5 lived in another state within the last five years. There are no background checks for the other state in staff 5's record. The director stated they did not obtain background checks for staff 5 for the other state.
2. The sworn disclosure statement for staff 6 documents staff 6 lived in another state within the last five years. A search of the central registry background was not completed for that state.
Plan of Correction: The documentation for the background checks will be completed and sent by 4/22/24. The licensing inspector will be kept up to date with the progress of completion. In the future the director will ensure out-of-state background checks are completed upon hire.
