Inspector Notes
The Licensing Inspector conducted an investigation in response to a self-reported incident that was initiated jointly with a local government agency on July 31, 2023 and concluded on September 19, 2023. The report received by the department included allegations of forbidden actions.
The Center?s video recordings were observed, staff records were reviewed, staff interviews were conducted, and the Center?s policies and procedures were reviewed in response to the allegations.
The evidence gathered during the investigation did not support non-compliance with standards or law. Any additional violations not related to the self report but identified during the course of the investigation can be found on the violation notice.
Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to the department within 5 business days from the receipt. Please specify how the deficient practice will be or has been corrected. Please do not use staff names; list staff by positions only.
Any plans of correction not received within 5 business days will result in the plans not appearing on the Violation Notice and public website.

Violations
7Evidence:
1. During naptime, a high book shelf blocked the view of three cots. Staff #1 and Staff #2 were observed on the video seated across the classroom and unable to view the three children on their cots at naptime.
Evidence:
1. The ratio for the Pre-K classroom is 1 to 10. On July 27, 2023, the Pr-K classroom had a total of 20 children with two staff. Staff #1 is observed on video going into the bathroom inside of the classroom and the door closing for one minute and four seconds.
2. Two children were in the bathroom and 18 children were observed being supervised by Staff #2.
3. Staff #1 confirmed that they left the classroom out of ratio.
Evidence:
1. Staff #1 is observed on the video taking Child #1(4 years old) into the bathroom within the classroom and having the door close behind them.
2. Staff #1 stated that two children were in the bathroom and 18 children were inside of the classroom with Staff #2.
3. The Center's Bathroom Supervision Policy states " The door must remain open with a staff member standing near/at the doorway with a clear view of the other children outside the bathroom as well as the child(ren) in the bathroom".
4. In Staff #1's record, there was documentation of a signed Bathroom Supervision Policy document dated 10/10/2022.
Evidence:
1. Child #2(5 years old) is observed on video dropping a roll of paper towels on the floor after washing their hands. Staff #1 walks over to Child #2 and gets into their face and says something. Child #2 walks over to the library area and faces the wall. Child #2 shoulders are down and is upset. Staff #1 walks over to Child #2 and gets into Child #2's face. Child #2 leans to the right side.
Evidence:
1. Child #1 is observed on video not washing their hands after eating lunch and after toileting.
2. Staff #1 did not wash their hands after returning from the bathroom, before serving food or beverages, and after wiping a child's nose.
Evidence:
1. After snack, the tables were not cleaned and sanitized.
Evidence:
1. Staff #1 and Staff #2 did not sit with children during lunch and snack.
