During the inspection, the inspector reviewed the areas listed above. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Inspector Notes

An unannounced inspection was initiated on May 12, 2025 and completed on June 9, 2025 in response to a complaint received by the licensing office on May 8, 2025 relating to allegations of supervision and food allergies. This incident occurred in October 2024. The inspector reviewed 2 child files and 2 staff records. This inspection included document review and interviews.

The preponderance of evidence gathered during the investigation supports the allegations; therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.

Standard 8VAC20-780-130-A
The center shall obtain documentation that each child has received the immunizations required by the State Board of Health before the child can attend the center.

Child 2, (in attendance for 9 months) has an initial immunization record dated 28 days after first day of attendance.
Plan of Correction: We have retrained all administrative staff of the importance of reviewing the date of the
immunizations and the standard to receive the records timely as required by the state.
Standard 8VAC20-780-130-E
The center shall obtain documentation of additional immunizations once every six months for children under the age of two years.

Child 1 (enrolled 8 months) had no documentation of updated immunizations after the age of 6 months..
Child 2 (enrolled 9 months) had no documentation of updated immunizations after the age of 17 months.
Plan of Correction: We have retrained all administrative staff of the importance of reviewing the records and updating immunizations as required. We will have parents update records.
Standard 8VAC20-780-340-A
COMPLAINT RELATED
When staff are supervising children, they shall always ensure their care, protection, and guidance.

As written on the incident report from October 2024, in the child file and confirmed in interview, Staff A gave Child 1 food which potentially contained an allergen as listed on the allergy plan of the child. The child ate a bite of the food.
Plan of Correction: We have implemented a new policy of identifying (with parent permission) a child with a food allergen by using a red placemat at their table space. We conduct unannounced checks at meal times with teachers and assistants to make sure they are aware of food allergies in the classroom. We also have retrained the staff of identifying food allergens on labels, as well as, the importance of slowing down during food service and ensuring that proper plating of food occurs for each child with allergies.

COMPLAINT RELATED
A child with a diagnosed food allergy shall not be served any food identified in the written care plan.

The file of Child 1 states that child is allergic to eggs. Written incident report from October 2024, states that child ate a bite of the doughnut hole and Staff A was unaware if the food contained eggs, as she had forgotten which of them the child should have received.
