Inspector Notes

A monitoring inspection was initiated and concluded on 12/8/2022. There were 48 children present, ranging in ages from 2 1/2 years to 5 years old with 7 staff supervising. The inspector reviewed compliance in the areas of Religious Exempt; Background Checks Code; Carbon Monoxide, Child Abuse and Neglect, Mandated Reporting, and Medication Training. A total of 10 staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program

Based on a review of records and interview, the Exempt Facility failed to obtain a search of the abuse and neglect database for another state where an employee resided within the previous 5 year period.
Evidence:
10 Staff records were reviewed.
The record for staff #2 began employment in May 2022, contains a sworn disclosure statement that disclosed that she resided in North Carolina within the past 5 years.
The records for staff #2 does not contain the results of a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.
Plan of Correction: The administrator for the program misinterpreted the requirements for out of state background checks and thought that since North Carolina is an "NFF" state, that all three reports were not required.
"NFF" states where employees have resided do not require a Criminal History Search if the employee has a current Federal Fingerprint background check conducted. But they do require a search of the abuse and neglect registry.
A request for staff #2's North Carolina search of the abuse and neglect registry will be completed and sent out within 10 days.
