Inspector Notes
An unannounced self-reported investigation and monitoring inspection was conducted on 4/25/2022 and a follow-up inspection visit was conducted on 4/29/2022, in response to a self-reported incident that was received by the Fairfax licensing office on 4/22/2022, regarding behavioral guidance and forbidden actions. Based on interviews and records reviewed the evidence gathered during this investigation does support the self-report of non-compliance with the standards or law and violations were issued. There were 54 children (infants-5yrs.) directly supervised by 8 staff. The physical plant, 5 staff records, 5 children?s records, medications, evacuation drills, emergency supplies, and policies were inspected. Children were observed participating in group activities, reading books, playing outside, and eating lunch. There was an adequate supply of materials for the children. The center was clean and organized. Areas of non-compliance are identified on the Violation Notice.

4Evidence:
Staff #1 was hired on 9/19/2019. Results of criminal history findings from a state the employee had resided within the preceding 5 years were not obtained.
Evidence:
Child #4?s record contains documentation of immunization records that were last updated on 5/28/2022.
Evidence:
There was not one staff member on duty with a current Daily Health Observation certification.
Evidence:
1. Staff #1 stated that on the day of the incident, 4/22/2022, Child #1 (4 years-old) hit Child #2 (4 years-old) on the head with a book.
When Staff #1 became aware of the incident they stated that although they meant to tell Child #2 to ?protect themselves?, they accidently used the word ?hit?.
Staff #1 stated that: ?they made a mistake?.
2. Staff #2 stated that when they asked Staff #1 about the incident, Staff #1 stated
that during the incident they told Child #2: ?If Child #1 is hitting you, you need to hit back?. Staff #2 stated that Staff #1 admitted that they knew it was wrong to say that to the child.
3. On the day of the incident, Adult #1 was standing outside the classroom observing
children and staff interactions. Adult #1 stated that after Child #1 hit Child #2 on their head with a book, Staff #1 took Child #2 by their arm, walked over to Child #1 and instructed Child #2 to smack Child #1 on their head. Adult #1 stated that Staff #1 held Child #2?s arm and showed them how to hit back, then Child #2 proceeded to hit Child #1 on their own.
4. Actions or threats of punishment by another child are forbidden actions.
