SYSTEMIC DEFICIENCY
All agents shall undergo a criminal history record information check, a sex offender registry check and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.
A criminal record information check was not requested for one state in which Agent #1 has resided in the preceding five years.
A search of the child abuse and neglect registry was not requested for one state in which Agent #1 has resided in the preceding five years.
Based on historical records, on June 24, 2025, Staff #1 was contacted concerning the outstanding request for Agent #1?s out of state background checks for criminal history and child abuse and neglect registry. On September 30, 2025, October 1, 2025, and November 18, 2025, Agent #1, Staff #1 and and Staff #2 were contacted about the outstanding request for Agent #1's out of state for criminal history and child abuse and neglect registry. At that time, the center indicated that Agent #1 would no longer serve as an agent of the licensee; however, on February 11, 2026, it was determined that Agent #1 was still serving in the capacity of an agent who is authorized to act on behalf of the licensee.
Agent #1?s out of state criminal history and central registry checks were not requested until February 11, 2026, after Agent #1 was contacted about acting as an agent for the licensee in an official capacity.
Agent #1 has been affiliated with the licensee for 11 months.
