Inspector Notes

A complaint inspection was initiated on 1/5/23 and concluded on 1/5/23. There were 7 children present with 1 caregiver. The point total was 18. The inspector reviewed compliance in the area of staffing and supervision.

The Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard 8VAC20-800-560-A
Based on interviews the provider failed to ensure that children were in direct care and supervision at all times as required.

Evidence:
On 12/20/23 around 5pm the children were not in direct care and supervision of staff for approximately 3 minutes due to a bathroom emergency. The children were downstairs in the child care area of the home and the staff was upstairs in the bathroom, as there is no adult size bathroom in the child care area of the home.
Plan of Correction: The provider will look at options to have an adult size bathroom area within the downstairs child care area of the home so that compliance will be met in case of future bathroom emergencies.
Standard 8VAC20-800-570-A
The provider failed to ensure that a caregiver does not exceed the allowed 16 points without having an additional caregiver present.

Evidence:
Upon arrival of the licensing inspector on 1/5/23 at approximately 9:05am there were 7 children present totaling 18 points with only the assistant present. The provider was not home due to a doctor appointment.
The 7th child was being dropped off when the inspector arrived, which caused the allowed points to go over 16.
Interviews determined that the provider left care at approximately 8:20am and returned to care at approximately 9:16am.
Therefore, compliance with this standard was not met from approximately 9:05am-9:16am.
Plan of Correction: The provider will plan accordingly for points per caregiver for future medical needs.
