During the inspection, the inspector reviewed the areas listed above. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Inspector Notes

An unannounced inspection was initiated on 4/7/2025 and completed on 4/14/2025 in response to a complaint received by the licensing office on 4/2/2025 relating to allegations in the areas of behavior guidance and forbidden action. The inspector reviewed 3 staff records on-site. This inspection included document review, and interviews.

The preponderance of evidence gathered during the investigation supports the allegation(s); therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law, and the violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five business days from today, which will be the close of business on 4/21/2025. A POC submitted after this date will not appear on the public website.

Standard 8VAC20-780-40-E
The center shall ensure that their activities and services are maintained in compliance with the standards and the center's own policies and procedures that are required by the standards.
1.The center?s required discipline policy states that employees should always use a calm, kind voice when speaking with children. Employees are to abstain from using any type of physical force whatsoever. Positive reinforcement methods are to be used to manage behavior.
2. The center was in violation of their policy on 3/27/25 when staff #1 used force to keep child #1 from coming through the classroom gate. Staff #1 used a loud and aggressive tone when attempting to redirect behavior in the classroom.
Plan of Correction: Staff member #1 was terminated immediately.
Standard 8VAC20-780-400-B
Behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.

1. On 3/27/25, staff #1 called a group of children in the toddler class to join a scheduled activity outside of the classroom. When one child attempted to come through the gate, staff #1 said ?no? in a loud and stern voice and pushed the child back through the gated area using a flat hand on the child?s chest. The child fell back into a seated position and cried. Staff #1 did not comfort the child. Three witnesses reported that incidents of inappropriate behavior guidance had been demonstrated by staff #1 to include harsh tones and words when redirecting children.
Plan of Correction: Staff member #1 was terminated immediately.
Standard 8VAC20-780-410-1
The following acts are forbidden: physical punishment, striking a child, roughly handling or shaking a child, restricting movement through binding or tying, forcing a child to assume an uncomfortable position, or exercise as punishment.

On 3/27/25, Staff #1 engaged in rough handling when they used their palm to push a toddler aged child backwards by their chest. The child fell into a seated position and cried.
Plan of Correction: Staff member #1 was terminated immediately.
