Inspector Notes
A self reported incident involving supervision and behavioral guidance of a child was investigated on 11/01/2022.. Observation of the center's video recording of 10/27/2022, a review of staff and child records and written staff statements were reviewed and staff interviews were conducted. During the investigation, violations were determined pertaining to behavioral guidance, staff supervision, staff to child ratio and parental involvement. Violations
4Evidence:
1.The ratio requirement for the Intermediate Class is 1 staff to 10 children.
2.On 10/27/2022, Staff #1 left the Intermediate Class which left Staff #3 alone with a total of 15 children.
Evidence:
1. On 10/27/2022, the center?s video recording system recorded Staff #1 removing Child #1(4 years) from the Intermediate Classroom and taking Child #1 to the PreK Classroom.
2. Staff #1 stated that Child #1 had thrown his lunch on the floor of the classroom and would not pick the food up.
3. Staff #1 stated ?[Child #1] doesn?t listen to me. I needed a minute. I was frustrated. I held his wrist and walked [Child #1] to the Pre K class.?
4. Once Child #1 was in the Pre K class, the center?s video recording system recorded Staff #2 moving Child #1 by lifting the child off the ground. Staff #2 was observed lifting Child #1 by placing their forearms under the child?s armpits and moving him to a carpeted area of the class.
5. Staff #2 stated ?I picked [Child #1] up in the heat of the moment.? Staff #2 stated that Child #1 was screaming loudly the whole time the child was in the room.
6. The video recording showed Staff #2 lead Child #1 to the bathroom. According to Staff #2 ?I took [Child #1} to the bathroom so they could calm down. Staff #2 stated, ?I bent down to talk to [Child #1]. Staff #2 stated while doing so, Child #1 kicked them. Staff #2 stated they became frustrated and left the bathroom by closing the bathroom door leaving Child #1 alone.
-Staff reviewed the ?Positive Behavior Support Policy, Acknowledged the Forbidden Actions regarding classroom management.

Evidence:
1.Staff #2 was observed taking Child #1 to the bathroom to provide behavioral guidance.
2.Staff #2 was observed leaving the bathroom and was recorded closing both the bottom and top half of the door, leaving Child #1 alone for approximately 13 seconds.
3.According to Staff #4, they overheard a child screaming from the hallway and adjoining classroom. The center?s video recording showed Staff #4 entering the PreK classroom, opening the bathroom door and finding Child #1.
4.Staff #2 stated ?It was unacceptable and I wouldn?t appreciate it done to my child. There was no specific length of time that I had planned to leave [Child #1] in there.? Staff #2 stated that ?I just needed a minute because [Child #1] kicked me.?

Evidence:
1.According to administration, Staff #1 and #2, Child #1 routinely exhibits behavioral problems. Staff #1 stated that ?[Child #1] doesn?t ever listen? and that Child #1 exhibits behavioral issues daily.
2.Staff #1 stated ?We have told the previous director about [Child #1] all the time and nothing was done.
3.In reviewing the child?s record and the Center?s electronic method of communicating, one message dated 10/04/2022 to Child #1?s parents was found regarding the child?s disruption at naptime.
4.No other documentation was found that staff had informed the parents of Child #1?s persistent behaviors.
-Staff will notify the administrators of ongoing behavioral issues.
