Inspector Notes
The licensing inspector conducted an unannounced complaint inspection on January 24, 2024, in response to a complaint received by the department on January 23, 2024, for allegations regarding forbidden action. On Wednesday, January 24, 2024, the inspector was on site from 9:20 am until approximately 12:05pm. Interviews were conducted, observations were made at the center, and documentation was reviewed.
Based on the information gathered during the investigation, the preponderance of evidence supports the allegation, therefore the complaint is determined to be valid. Violations were documented on the violation notice issued to the program.
Please complete the 'plan of correction' and `date to be corrected' for each violation cited on the violation notice and return it to me within five business days from today. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Violations
2Evidence:
On 1/22/2024 between approximately 1:15 PM and 1:30 PM, staff #1 witnessed staff #2 take a pacifier from child #1 (2-year-old) . Staff #1 reported that child #1 was being weaned off the pacifier. When staff #2 took the pacifier from child #1, the child became upset and began to cry. Staff #1 reported that staff #2 became aggressive and confrontational with the child. Staff #2 begin forcefully rolling child #1 onto the child?s stomach and forcefully smacked child #1?s hand. Staff #1 stated that staff #2 then forcefully held child #1?s head down on the mat that the child was resting on. Child #1 then begin to scream and staff #2 snatched the child from the mat and stood the child up. Staff #2 then told child #1 that she would throw away the pacifier and then placed the child back on the mat. Child #1 continued to scream and staff #2 continued trying to hold child #1 down on the mat for approximately 1 to 2 minutes.
Evidence:
Staff #1 reported seeing staff #2 hold child #1?s head down on a mat during nap for approximately 1- 2 minutes.
