Inspector Notes

An unannounced code compliance inspection was initiated on 10/31/2023 and concluded on 10/31/2023 from 9:50 AM to 11:45 AM. There were 59 children present, ranging in ages from 2 months to 5 years, with 16 staff. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, procedures, and medication. A total of five children?s records and five staff?s records were reviewed. One repeat violation was found.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Based on record review and interview, the center failed to ensure all staff have been certified by a practicing physician or physician assistant to be free from any disability which would prevent him/her from caring for children under his/her supervision prior to start date.

Evidence:

1. The record for staff 5 documents the employment date as 5/4/22. The staff health report is dated 5/4/22.
2. The director verified the dates.
Plan of Correction: Staff health reports will be required prior to staff's first day of work.

Based on record review and interview, the center failed to request a search of central registry background check within the first 30 days of employment, and a criminal history name check prior to the first day of employment for any state in which a staff member resided in the preceding five years.

Evidence:

1. The record for staff 4 documents the employment date as 1/24/23. The sworn statement completed by staff 4 documents staff 4 lived in another state within the preceding five years. The record did not contain documentation of completing background checks in the other state.
2. The director verified out-of-state background checks for not completed for staff 4.
Plan of Correction: The out-of-state background checks will be processed within 10 days and the results will be forwarded to the licensing inspector.
In the future the director will ensure out-of-state background checks are completed within the required timeframe.

(REPEAT VIOLATIONS) Based on record review and interview, the center failed to have a completed central registry record check by the end of the 30th day of employment.

Evidence:

1. The record for staff 5 documents the employment date as 4/5/22. The central registry background check is dated 7/7/22.
2. The director verified the dates.
Plan of Correction: Staff will be required to complete the paperwork for background checks prior to the first day of working. The paperwork will be processed within seven days.
