Inspector Notes
An unannounced complaint inspection was initiated on 10/19/2022 from 9:30am to 10:45am in response to a complaint received in the licensing office regarding behavioral guidance and forbidden actions with 2 staff members. Interviews were conducted with staff, policies and procedures were reviewed, classrooms were observed, and documentation was viewed. Children were observed participating in math activities, legos, dramatic play, and sensory exploration. Staff to child ratios were in compliance during the inspection. Based on the preponderance of evidence collected throughout the investigation, the complaint regarding behavioral guidance was determined to be valid. Three citations were issued as a result of the findings of the investigation. The remaining citations were discovered during the inspection. The exit interview was conducted on 12/7/2022 with a manager. 6Evidence: The record for Staff #2 (date of hire 10/25/21) did not contain documentation of a completed criminal history record check from all states (Texas) where they resided within the last five years.
Evidence: The file for Staff #1 (Date of hire 1/3/2022), who is a lead teacher, did not contain documentation of the required education or experience for the position.
Evidence: The record for Staff #2 (Date of hire 10/25/2021) did not contain documentation that the Virginia Department of Education-sponsored orientation course was completed within 90 calendar days of employment
Evidence:
1)Staff #1 admitted that when Child #1 does not listen to them, they have yelled at the child as a method of correcting the problem behavior. The staff member stated, ?I will admit I went a little too far and yelled at Child #1?. Staff #1 admitted he doesn?t remember requesting help from the management staff about his concerns with Child #1?s behavior.
2) The Director recalled a situation where the children were transitioning and the group became a little chaotic. The Director heard Staff #1 use a tone that they felt was ?scary? to the children. The Director stated, ?Staff #1 used their `scary parent voice? with the children on one occasion that I can remember.? In this instance the Director intervened and assisted Staff #1 with the group of children.
Provide staff member with positive guidance training.
Evidence: The file for Staff #2 did not contain documentation for completion of first aid and cardiopulmonary resuscitation (CPR) certification that included an in-person competency demonstration. The CPR certification documentation on file is from a training company that states, ?We are not affiliated with the American Heart Association (AHA), Red Cross or OSHA?.Our courses do not require a live hands on skills check.? Staff #2 stated that they have been the only staff member in a classroom on many occasions.
Evidence: There was no documentation that the center had obtained at least two references as to character, reputation, and competency for Staff #1 before employment.
