Inspector Notes

A complaint investigation was initiated on December 18, 2023 and concluded on January 16, 2024 in response to a complaint received by the department on December 12, 2023 regarding custodial parent?s visitation rights. The licensing inspector spoke to witnesses, viewed video recordings, and reviewed documentation on December 18, 2023, December 28, 2023 and January 5, 2024. The licensing inspector was onsite conducting an inspection on January 16, 2024. Interviews with staff were completed, observations were made at the center, and documentation was reviewed.

The preponderance of evidence gathered during the investigation does support the complaint; therefore, the complaint was determined to be valid.

Please complete the plan of correction and date to be corrected for each violation cited on the violation notice, sign and return it to me within 5 business days from the date of receipt. You should specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the stand(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Based on video recording and interviews, a custodial parent or guardian was denied admission to a child day program.

Evidence:
The following information was determined from interviews, videos, and documentation review:
1. A custodial parent arrived at the center to visit with Child #1 on December 7, 2023 at approximately 10:40am.
2. Video recording showed Staff #1 denied entry to the custodial parent.
3. The record for Child #1 contained paperwork indicating the parents of Child #1 shared joint legal custody.
