Inspector Notes
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A complaint inspection was initiated on March 23, 2021 and concluded on April 22, 2021. A complaint incident was received by the department regarding allegations in the areas of Supervision, Special Services and Programs. The director was contacted by telephone to conduct the investigation. The inspector emailed the director a list of documentation required to complete the investigation. The inspection included virtual observation of t center, a review of center documentation, observation of photographs and interviews with parties involved. The evidence gathered during the investigation supported the allegations of non-compliance with standards or law and violations were issued.

Violations
2Evidence: The center's documentation dated 3/12/2021, 3/15/2021, 3/16/21 and 3/17/2021 showed that Child #1 bit Child #2, six times in a four business day period. The documentation and photographs reviewed confirmed the bites left red bruising, visible bite marks and broken skin. The center did not protect Child #2 as Child #1 was able to continuously bite Child #2.
There is a mandatory staff training tomorrow, 4/27/2021 from 6:30-8:30pm about Biting and Primary Care Groups a trainer from VA ITSN will lead this session. We are partnering with a VA ITSN specialist to do onsite coaching in the Infant and Toddler classrooms beginning May 3.
Evidence:
The centers own "Behavior management Policy" includes the following information related to "action taken when biting occurs". "Both sets of parents are contacted or notified at pick up". An accident/incident report is written for each of the children involved. Six accident/ incident reports were reviewed and the parties involved and centers documentation confirms all of the parents involved were not notified the day of the incident as listed below.
1) The centers documentation indicates a biting incident occurred on 3-12-2021 at 10:30 am and at 3:30 pm the "parent was notified verbally/in person on 3-17-21 at 11:10 am".
2) The centers documentation indicates a biting incident occurred on 3-15-2021 at 9:45 am and the "parent was notified verbally/in person on 3-17-21 at 11:10 am".
3) The centers documentation indicates a biting incident occurred on 3-16-2021 at 10:00 am and the "parent was notified verbally/in person on 3-17-21 at 11:10 am".
4) The centers documentation indicates a biting incident occurred on 3-16-2021 at 11:20 am and the "parent was notified verbally/in person on 3-17-21 at 11:00 am".
5) The centers documentation indicates a biting incident occurred on 3-17-2021 at 10:00 am and the "parent was notified verbally/in person on 3-17-21 at 11:10 am".
The center's staff and parties involved confirmed they were not always notified the day of a biting incident and the behavior management policy was not followed related to biting.
