Inspector Notes

An unannounced monitoring inspection was initiated on 7/3/24 and completed on 7/5/24 in response to a self-report received by the licensing office on 7/2/24 relating to care and protection, behavioral guidance and forbidden action. The inspector reviewed 1 children?s record and 1 staff records on-site on 7/2/2024. This inspection included document review, tour of the facility, interviews, and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the deficient practice will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 8/30/24. A POC submitted after this date will not appear on the public website.

Standard 8VAC20-780-340-A
Based on staff interviews and document review, staff supervising children did not always ensure their care, protection, and guidance.
Evidence:
1. On July 2, 2024, Child #2 (age 8) stated that when Child # 1 (age 6) threw a toy at Child # 3 (age 9), Child #1 started to run after Child # 3. Child # 2 saw Staff # 1 going after Child # 1 to stop them.
2. At approximately 5:07pm and 5:15pm, Staff #1 slapped Child # 1 on the left cheek as they ran after the child for throwing a toy at child #3
3. Child # 2 stated that they heard and saw Staff #1 slap Child # 1. In response to the slap, Child # 1 started to cry.
4. Child #1 touched their left cheek when asked about where Staff # 1 slap them.
5. Staff # 1 stated ?When running after boys my hand go to Child #1?s face accidentally. I don?t know I touched his cheek. Just like tap. I?m not hurting?.
6. Staff #1 reported to Staff #2 that they ?did not hit him?, Staff #1 demonstrated their action to Staff #2 by moving their hand towards Staff #2?s cheek.
Plan of Correction: Employee terminated effective 7/16/2024.
Standard 8VAC20-780-40-E
Based on review of the center?s policies and procedures and staff interviews, the center did not ensure that staff followed the center?s own policies and procedures required by the standards regarding positive guidance and discipline policies.
Evidence:
1. The center?s policy on positive guidance states:? Bright Horizons prohibits the following: ? Subjecting children to cruel, severe, or frightening punishment such as shaming, humiliation, threats, derogatory remarks, verbal or physical abuse, neglect, or abusive treatment including hitting, shaking, jerking, squeezing, spanking, yelling, and choking.?
2. The policy also states, ?Use appropriate redirection and provide children with alternatives that enable them to engage appropriately; Guide and encourage the development of social-emotional skills such as cooperation, problem solving, and self-regulation?.
3. On 7/2/2024 Staff #1 did not follow the center?s policy on positive guidance. Staff #1 used a forbidden action and slapped Child#1 (age 6) on the left cheek as they were running after the child for throwing a toy at Child #3 (age 9).
Plan of Correction: All staff have been retrained on our positive guidance policies.
Standard 8VAC20-780-400-B
Based on interviews and document review, the center failed to ensure behavioral guidance was constructive in nature, age and stage appropriate, and included redirecting children to appropriate behavior and resolve conflicts.
Evidence:
1. On July 2, 2024, between approximately 5:07pm and 5:15pm, Staff #1 slapped Child # 1 (age 6) on the left cheek.
2. Child #2 (age 8) stated that when Child # 1 threw a toy at Child # 3 (age 9), Child #1 started to run after Child # 3. Child # 2 saw Staff # 1 going after Child # 1 to stop them.

Standard 8VAC20-780-410-1
Based on interviews and document review, the center failed to ensure the following actions or threats were forbidden striking a child. Based on interviews with staff, parent and children, it was determined that staff used a forbidden action of striking a child.
Evidence:
1. On July 2, 2024, between approximately 5:07pm and 5:15pm, Staff #1 slapped Child # 1(age 6) on the left cheek.
2. Child #2 (age 8) stated that when Child # 1 threw a toy at Child # 3 (age 9), Child #1 started to immediately run after Child #3.
3. Child # 2 saw Staff # 1 going after Child # 1 to stop them. Child # 2 stated that they heard and saw Staff #1 slap Child # 1. In response to the slap, Child # 1 started to cry.
4. Child # 2 stated that ?She slapped Child #1 on the cheek. She said it?s okay. Child #1 looks like her son.?
5. Child #1 touched the left cheek when asked where Staff # 1 slap them.
6. Parent stated that Child # 2 saw Staff #1 ?hit/slap Child # 1?.
7. Parent also said that Child # 2 stated ?I heard it, Child #1 was crying?, ?Staff #1 walked fast to him, and Staff #1 slapped him?.
8. Staff # 1 stated ?When running after boys my hand go to Child #1?s face accidentally. I don?t know I touched his cheek. Just like tap. I?m not hurting?.
9. Staff #1 reported to Staff #2 that they ?did not hit him?, Staff #1 demonstrated their action to Staff #2 by moving their hand towards Staff #2?s cheek.
10. Staff # 2 stated that Staff #1 ?appeared flustered? and ?kept saying she didn?t hit him; Child # 1 is like my son?.
Plan of Correction: Employee has been terminated effective 7/16/2024. All staff has been retrained on our positive guidance policies.
