Inspector Notes

An unannounced inspection was initiated on 6/12/2024 and completed on 8/8/2024 in response to a complaint received by the licensing office on 6/12/2024 relating to allegations of forbidden actions and care, protection and guidance. This inspection included document review, tour of the facility, interviews, and observations. The preponderance of evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program. Though not a part of the original complaint, violations that were not reported were found related to administration and are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the deficient practice will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 8/19/2024. A POC submitted after this date will not appear on the public website.

Standard 8VAC20-780-170-A
Based on interview, the center did not obtain documentation from a physician or clinical psychologist skilled in the diagnosis and treatment of mental illness to confirm that any risk has been eliminated or can be reduced to an acceptable level by reasonable accommodations when there is evidence that the safety of children may be jeopardized by contact with a staff member because of the mental health of such staff member.

Evidence:
1. Interviews revealed on 6/11/2024 at approximately 4:00pm in the Infant A room, Staff #1 was visibly "frustrated and angry", made a gesture using both hands and stated "[Child #1] has been screaming and screeching all day, I want to strangle [Child #1]".
2. Interviews revealed management is aware that Staff #1 is "overwhelmed and stressed out".
3. Interview revealed that on a regular basis when Staff #1 reaches their limit Staff #1 will "put the baby down, walk away and go bang my head on the window until I can calm down".
4. Interviews revealed Staff #1 is regularly the only direct caregiver in the Infant A classroom.

Based on interviews, the center did not ensure that staff do not engage in a forbidden action - verbal remarks which are demeaning to the child.

Evidence: Interviews revealed Staff #1 stated on at least two occasions in May 2024 "you're being a pest" to Child #1 (Age 12 months at the time of incident).
