8VAC20-780 Administration.

During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Inspector Notes

An unannounced inspection was initiated on 9/11/2024 and completed on 9/25/2024 in response to a complaint received by the licensing office on 9/11/2024 relating to allegations of staff mental health. The inspector reviewed 1 staff record on-site. This inspection included document review and interviews. The preponderance of evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 12/19/2024. A POC submitted after this date will not appear on the public website.

REPEAT VIOLATION

When there is evidence the safety of children may be jeopardized by contact with a staff member due to their mental health the center is required to obtain documentation from a physician or clinical psychologist skilled in the diagnosis and treatment of mental illness before staff return to work. This documentation shall confirm any risk to children has been eliminated or can be reduced to an acceptable level by reasonable accommodations.

Staff #1 was placed on leave following concerns regarding their mental health after Staff #1 reported becoming so overwhelmed and stressed that they would regularly have to stop caring for children to go bang their head on the wall until they calmed down and could resume their duties. Staff #1 was allowed to return to work on 9/5/2024 with a note indicating they should have no more than one hour of working independently. However, this note is signed by a nurse and not a doctor or clinical psychologist skilled in the diagnosis and treatment of mental illness as required by the standards. In addition, information was gathered that Staff #1 has been working independently 2-3 hours daily, exceeding the one hour limitation.
Plan of Correction: Updated paperwork will be received from a licensed physician or clinical psychologist, stating that Staff #1 may work a total of 30 hours per week until further evaluation. However, they are not to be left alone for more than one hour at a time.
