An unannounced non-mandated monitoring focused inspection was conducted on Thursday, February 9, 2023 in response to an Intensive Plan of Correction (IPOC) presented to the facility on December 15, 2022 and completed/accepted on January 30, 2023. The licensing standards addressed in the plan included: 22.1-289.035-B-4; 8VAC20-770-60-C-2; 8VAC20-780-160-A; and 8VAC20-780-70. On February 9, the inspector was on-site on from 12:10pm until approximately 12:55pm. Three staff records were reviewed during the inspection. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Based on a review of three staff records and interview, the center did not obtain a copy of the results of a criminal history record information check or a sex offender registry check from any state in which one staff member had resided in the preceding five years within the required timeframe.
Evidence: 1) The record of Staff #1, employed on 12/28/22, indicated the staff had resided in another state outside of Virginia within the last five years. The record did not contain a copy of the results of a criminal history record information check or a sex offender registry check from that state. The out-of-state criminal history record information check and the sex offender registry check are required to be obtained prior to employment.
2) During interview, management reported the required out-of-state background checks for Staff #3 were not obtained prior to employment. They were requested on 01/30/2023.

Plan of Correction: Corrected. The required out-of-state background checks for Staff #3 have been requested and will be filed upon receipt. In the future, all out-of-state background checks will be requested prior to employment and within the required timeframe.
