Inspector Notes
An unannounced inspection was initiated on 8/9/2024 and completed on 8/9/2024 in response to a complaint received by the licensing office on 8/7/2024 relating to allegations of supervision of children. The inspector reviewed one child and two staff records on-site on 8/9/2024. This inspection included document review (policies and procedures), tour of the facility, interviews, observations (recordings).
The preponderance of evidence gathered during the investigation supports the allegation(s); therefore, the complaint is determined to be valid. Information gathered during the inspection determined non- compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.
Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the deficient practice will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 9/4/2024. A POC submitted after this date will not appear on the public website.
Violations
4Evidence:
1. Review of video footage, time stamped 7/30/2024, Child #1, (age 3), was observed without the presence of a staff member from approximately 4:05pm-4:07pm.
2. During staff interviews, on 8/9/2024, Staff #1 confirmed that a parent informed her on 7/30/2024, that a child was in the parking lot without the supervision of an adult.
3. Review of video footage, time stamped 7/30/24, Child #1 was observed walking across the crosswalk to the sidewalk. Child #1 then turns and runs back into the crosswalk. Staff can be seen walking toward the child, Child #1 runs back to the fence. Staff then turn and walks away. Child #1 then return to the parking lot. Staff did not ensure the child returned to the fenced play yard.
4.The Parking lot has a crosswalk from the playground to the main building, that intersects two lots for parking. Parking lot has immediate access to the main road, without a secured entrance or fencing.
Evidence:
1. Based on the video footage recorded on 7/30/2024, Child #1, (age 3), opened the playground gate, left the playground, and went into the parking lot. Child #1 was on the parking lot for approximately two minutes until an administrative staff assisted the child back onto the playground. The child?s teacher was observed standing near the picnic table at the bottom of the hill.
2. Staff #2 confirmed that she was not aware that the child had left from the playground until Staff #1 returned him back into her care.
Evidence:
1. Two staff verified during interviews conducted on 08/09/2024 that there were six children, on the playground with one staff member.
2. The playground is located across from the center, and the children have to cross a parking lot to get the playground.
Evidence:
1. In the Center?s Playground Policy, procedure #2 lists ?Teachers must always ensure that children stay within sight and sound supervision, as a teacher should be able to see and hear all children from his/her vantage point?. Child #1 was out of sight and sound supervision of staff on 7/30/2024 for approximately two minutes. Child #1 left the playground area and was found in the parking lot by a parent who notified administration.
2. In the Center?s Playground Policy, procedure #3 lists ?Teachers should position themselves on the playground so that they can collectively monitor all zones of the playground?.
3. On the video footage recorded on 7/30/2024, Staff #2 is stationed at the bottom of the playground hill, standing next to the picnic table, observing the children on the playground. There was a tree in front of the picnic table that obstructs the view of the playground equipment where children were observed playing.
