Inspector Notes
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program.
A monitoring inspection was initiated on 03/03/2022 and concluded on 03/21/2022. The director was contacted by telephone and a virtual inspection was conducted. There were 28 children present with 9 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of three child records and three staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.
Violations
3Evidence: 1) The record for Staff #1, hired on 08/23/21, indicated the staff had resided in another state outside of Virginia within the last five years. The results of the criminal history record information check were dated 08/24/21, the results of the sex offender registry check were dated 08/24/21, and the search of the out-of-state child abuse and neglect registry was dated 03/15/22.
2) The record for Staff #3, hired on 10/01/21, indicated the staff had resided in another state outside of Virginia within the last five years. The record did not contain a search of the sex offender registry check from that state. An out-of-state criminal background check was not required because the state participates in the National Fingerprint File (NFF) program through the FBI.
3) During interview, a member of management confirmed the required out-of-state background checks were not obtained for Staff #1 and Staff #3 within the required time frames. The out-of-state criminal history record information check and the sex offender registry check are required to be obtained prior to hire. The out-of-state search for founded complaints of child abuse or neglect is required to be requested within the first 30 days of being hired.
Evidence: 1) The central registry finding in the record for Staff #3, hired on 10/01/21, was dated 11/08/21. 2) During interview, a member of management confirmed the central registry finding was not received within 30 days of Staff #3's date of employment.
Evidence: 1) One of two references in the record for Staff #1, hired on 08/23/21, was obtained on 09/02/21. 2) The references in the record for Staff #3, hired on 10/01/21, were obtained on 10/04/21. Each staff record should contain documentation that two or more references as to character and reputation as well as competency were checked before employment or volunteering.
