Inspector Notes

The Department received a complaint regarding staff qualifications. A complaint inspection was initiated on 06/01/2022 and concluded on 07/26/2022. On 07/26/2022, the licensing inspector was onsite from approximately 11:30am until 12:30pm. The inspector conducted interviews, completed observations and reviewed documentation.

The evidence gathered during the investigation did not support the allegation of non-compliance with standards or law. Any other violations not related to the complaint but identified during the course of the investigation can also be found on the violation notice.

Based on review of two staff records and interview, the center did not obtain satisfactory results of a national fingerprint based criminal record search within the required time frame.

Evidence:
1. The record for Staff #1 (hire date 07/11/2022) contained the results of a national fingerprint based criminal record search dated 11/12/2019.
2. A member of management stated Staff #1 was is a rehire.
3. Fingerprint searches are required to be obtained no more than 90 days prior to being hired.
Plan of Correction: I have requested the national criminal record check.
Standard 8VAC20-770-60-B
Based on review of two staff records and interview, the center did not obtain a completed sworn statement or affirmation within the required timeframe.

Evidence:
1. The record for Staff #1 (hire date 07/11/2022) contained a completed sworn statement of affirmation dated 05/25/2019.
2. A member of management stated Staff #1 was is a rehire.
3. A sworn statement is required to be obtained no more than 90 days prior to being hired.
Plan of Correction: I will have the staff member complete an updated sworn statement.
Standard 8VAC20-780-160-A
Based on review of two staff records and interview, the center did not ensure one staff member did not obtain results of a tuberculosis (TB) screening within the required timeframe.

Evidence:
1. The record for Staff #1 (hire date 07/11/2022) contained a TB screening dated 09/11/2019)
2. A member of management stated Staff #1 was is a rehire.
3. Results of a negative TB screening are required within 30 days prior to staff beginning employment.
Plan of Correction: I will send the staff member for an updated TB screening.
