Inspector Notes

A self-reported incident was received in our office on March 29, 2024 concerning supervision and care and protection care. An investigation was initiated on April 3, 2024, and concluded on April 9, 2024. Based on documentation, interviews, and video footage, violations were documented in regard to the self-reported incident. A violation not related to the self-report was also documented. Standard 8VAC20-780-140-A
Based on record review, the center did not obtain documentation of a physical examination before the child's attendance or within 30 days after the first day of attendance.
Evidence:
1) Child #1 (date of enrollment: 07/06/2023) did not have a physical examination in the record available for review during the inspection.
Plan of Correction: Our Administrative Coordinator has been retrained in using our data systems to ensure all children's files are compliant with children's physical examine documentation obtained within 30 days of the child's initial attendance. In addition utilizing our checklist will ensure human error is eliminated and avoid any future violations.
Standard 8VAC20-780-340-A
Based on review of video and interviews, staff supervising children did not always ensure their care, protection, and guidance.
Evidence:
1) On 04/03/2024 video footage showed at approximately 4:57pm, Child #1 (23 months) falling to the ground to their hands and knees. Staff #1 is observed lifting Child #1 up to a standing position from the ground by his left hand. Child #1 is then observed holding their left arm.
2) On 03/27/2024 Child #1 was picked up by a parent. The parent later contacted the facility on 03/27/2024 to report that Child #1 was diagnosed by a physician as "having nursemaid's elbow" on their left arm.
Plan of Correction: Although the staff involved in the incident had all good intentions of comforting the child, she has been retrained on the proper way of lifting children rather than lifting by their hands. The health and safety of our children has always been a priority. We will continue to make this a priority by having all of the Bright Start staff (and new employees through Orientation) receive information and training on the proper way to physically lift children.
