8VAC20-790 Subsidy Program Vendor Requirements for Child Day Centers

Inspector Notes

An unannounced subsidy inspection was initiated on July 30, 2024 and completed on September 12, 2024 in response to a complaint received by the licensing office on July 30, 2024 relating to allegations of parental involvement and supervision. The inspector reviewed 1 staff record electronically on September 12, 2024. This inspection included document review, tour of the facility, interviews, observations and measurements. The preponderance of evidence gathered during the investigation supports the allegation(s); therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the deficient practice will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on September 19, 2024. A POC submitted after this date will not appear on the public website.

Standard 8VAC20-790-570-1
Based on interviews, vendor did not ensure the department?s inspector is notified as soon as practicable, but not more than one business day when a missing child requires local authorities to be contacted for help.

Evidence: On 7/19/2024, child #1 (age 3) was missing from the facility. The child was found by a person unknown to the child or the staff at approximately 9:20 am and law enforcement was notified by that person to determine where the child belonged. Staff #2 found the child at approximately 10:05 am. The vendor did not notify the department. The department was notified of the incident by local department official on 7/30/2024.
Plan of Correction: The staff was immediately reminded of center policy that no child should ever be out of sight and sound of a staff member. We continue to emphasize this and it has been clearly stated in the employee handbook. Staff must sign a separate statement of this policy and failure to comply with result in termination.

Staff will provide sight and sound supervision of the children at variable and unpredictable intervals not to exceed 15 minutes. Staff will have a form to document children's whereabouts every hour of the day.

Based on interviews and review, vendor did not ensure children less than 10 years of age are always within actual sight and sound supervision of staff.

Evidence: On 7/19/2024, child # 1 (age 3) was outside with approximately 34 children (infants through school age) and 6 staff for waterplay. Child #1 left the play area and walked 0.3 mile to include crossing a 2-lane, well-traveled divided road with a speed limit of 35 mph. Staff did not observe the child leaving the facility. At approximately 9:20 am, Child #1 was discovered by a person unknown to the child or the staff. Child #1 was brought into that person?s home, and they notified law enforcement. At approximately 10:05 am, staff #2 found the child at the collateral?s home after being directed to the home by neighbors. Child was not in actual sight and sound supervision of staff from approximately 9:10 am ? 10:05 am.

Based on interviews and review, vendor did not ensure a parent is notified immediately if a child is lost.

Evidence: On 7/19/2024 between 9:10 am ? 9:20 am, staff realized they did not know the whereabouts of child #1 (age 3). Staff began searching the facility inside and outside. After completing the search at the facility, two staff got in personal cars and began searching adjoining roads. Staff #2 found child #1 at approximately 10:05 am. Staff did not notify parent that child was missing. Parent was notified by law enforcement when they responded to the scene of where the child was found by a person unknown to the child or the center?s staff.
