Inspector Notes
A complaint inspection was initiated on 05/25/2022 and concluded on 07/14/2022. An in person inspection was conducted 18 children present and 5 staff present. Staff were interviewed and observation were conducted. The complaint was in regards to forbidden action. There was preponderance evidence that deemed the complaint is valid.
Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the program.

Based on staff interview and documentation, the vendor did not ensure the following actions or threats thereof are forbidden: Physical punishment, including striking a child, roughly handling or shaking a child, restricting movement through binding or tying, forcing a child to assume an uncomfortable position, or using exercise as punishment.
Evidence :
1. Staff #1 stated she has been given permission from a parent in the program to use physical punishment on her children. Staff #1 provided the licensing inspector with a text from a parent of an enrolled child that states "I do give permission for Staff #1 to pop my kid if all other avenues of discipline have been done and they are not behaving."
2. Staff #1 also said she is the only staff at the center able to pop the children. Staff #1 showed the licensing inspector the paint stirrer that she would use for popping the children.

Plan of Correction: Center director stated that she never popped children. She would take out the paint stirrer to show them the seriousness of not listening and what could happen.
Now since the Director has been made aware that even with parent permission that popping and threatening is not allowed. It has been corrected.
We are now just using the cool down table for redirection and speaking with children and helping them understand the reason for being separated. Parents are made aware if the child is continuing with behavioral concerns.To reinforce change of behavior.
