Inspector Notes

The licensing inspector conducted an unannounced complaint inspection in response to a complaint received by the department on March 7, 2023. The complaint was regarding allegations of non-compliance in the areas of supervision, forbidden action, and food services. On Thursday, March 16, 2023, the inspector was on site from 10:00am to approximately 11:40am. Interviews were completed, observations were made at the center, and documentation was reviewed. Additional interviews were conducted off-site and additional information was submitted to the inspector electronically. The preponderance of evidence gathered during the investigation supports part of the allegation, therefore the complaint is determined to be valid. See the violation notice for more details.

Please complete the `plan of correction' and `date to be corrected' for each violation cited on the violation notice and return it to me within 5 business days from the date of receipt. You should specify how the deficient practice will be or has been corrected. Based on a review of documentation and interviews, the center did not ensure when staff are supervising children, staff shall always ensure their care, protection, and guidance.

Evidence: It was determined that Staff #1 did not ensure the care of Child #1 (2-years-old) on 03/03/23 when the staff picked up the child by one hand. The child sustained a dislocated elbow as a result of Staff #1?s action.

1) A written report completed by the center for Child #1 describes an injury sustained by Child #1 on 03/03/23. The report indicates: ?[Child #1] began holding her arm as if in pain after her teacher helped her stand up by pulling with her hand.?
2) On a written statement dated 03/07/23, Staff #1 indicated the following: ?I noticed [Child #1] was struggling to place a toy inside a friends (sic) bookbag, so I walked over to assist her. She was sitting on her knees, so I went to grab her hand to stand her up as I pulled her up, she pulled her body weight back down but eventually put her legs down. She then went and sat down but was holding her wrist. Once I noticed I asked her was she ok. Once Me & [Staff #2] saw she couldn?t move it without shaking she was then taking (sic) Get Well to see Nurse [Staff #3].?
3) On a written statement dated 03/07/23, Staff #4 indicated the following: ?A care plan was created for [Child #1] regarding the incident that occurred on Friday, March 3rd. [Staff #1] read the care plan and signed it. I provided education about how to properly pick up children when needed. She stated she understood and had no further questions about the education or care plan that is now in place.?
