Inspector Notes

The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing department on November 28, 2022 regarding allegations of staffing and supervision. The inspection was initiated on November 30, 2022 and completed on January 18, 2022. On November 30, 2022, the inspector was on site from 7:25 AM to 8:50 AM. Interviews with staff were completed, observations were made in the center, and documentation was reviewed.

The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. See the violation notice for more details.

Please complete the plan of correction and the date to be corrected for each violation listed on the violation notice and return it to the department within 5 business days from receipt. Based on observation and review of documentation, the center did not ensure staff to child ratio requirements for infants were maintained.

Evidence:
1. In class #2, a review of the staff to child ratio was conducted using the facility?s Face-To-Name Transition sheet for 11/30/2022. The following ratios were recorded on the Face-to-Name Transition sheet by staff #2. At 7:08 AM, 1:5 ratio with the youngest child being three months old. At 7:14 AM, 1:6 ratio with the youngest being three months old. At 7:18 AM, 1:7 ratio with the youngest child being three months old. Staff #3, arrives at 7:20 AM leaving the ratio 2:8. At 7:58 AM, 2:9 ratio with the youngest child being three months of old.
2. The assistant director stated that the classroom was not in ratio.

Based on information obtained during the inspection, the center did not ensure staff to children ratio requirements applicable to the youngest child in the group were followed when children were regularly in mixed age groups.

Evidence:
1. In class #1, a review of the staff to child ratio was conducted using the facility?s Face-To-Name Transition sheet for 11/30/2022. The following ratios were recorded on the Face-To-Name Transition sheet by Staff #1. At 7:00 AM, 1:9 ratio with the youngest child two years of age. At 7:08 AM, 1:10 ratio with the youngest child two years of age. At 7:15 AM, 1:14 ratio with the youngest child two years of age. At 7:28 AM, an additional staff member arrived leaving the ratio 2:14 with the youngest child two years of age.
2. The assistant director stated that room #1 was not in ratio during the morning gathering of mixed age groups.

Based on observation, review of the license and interview, the licensee failed to ensure that the center?s activities are maintained in compliance with the terms of the current license issued by the department.

Evidence:
1. The center?s own Child Supervision Procedure, section 2 states procedures for blending classrooms (opening and closing rooms), ?when mixing age groups or blending classrooms,... the staff must adhere to the ratio of the youngest child.?
2. The center?s own Child Supervision Procedure, section 1 states Infant classrooms must maintain a 1:4 ratio unless a stricter ratio is required by licensing.
3. The assistant director stated that the room #1 and room #2 were out of ratio throughout the morning of 11/30/2022.
