Inspector Notes

An unannounced, on-site (monitoring) inspection was initiated on (9-11-2024) and completed on (9-17-2024). The on-site inspection began at (1:40pm) and ended at (3:10pm). The inspector reviewed compliance in the areas listed above.
There were (39) children present and (7) staff. The inspector reviewed (5) children?s records and (5) staff records on-site and electronically on (9-16-2024). This inspection included document review, tour of the facility, interviews, and measurements. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.
Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the deficient practice will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on (9-23-2024). A POC submitted after this date will not appear on the public website.

Standard 8VAC20-780-330-B
Based on measurements and observations, the center did not ensure that where playground equipment is provided, resilient surfacing shall comply with minimum safety standards and shall be under equipment with moving parts or climbing apparatus to create a fall zone free of hazardous obstacles. Fall zones are defined as the area underneath and surrounding equipment that requires a resilient surface. A fall zone shall encompass sufficient area to include the child's trajectory in the event of a fall while the equipment is in use. Falls zones shall not include barriers for resilient surfacing.

Evidence: The playground had a spring rocker (zebra) and a spring rocker (tricycle) and both did not have the minimum of 6 feet of fall zone around the equipment . There was 3 feet 4 inches between the spring rocker (zebra) and a plastic caterpillar and on the other side there was 5 feet between the spring rocker (zebra) and the spring rocker (tricycle).
Plan of Correction: The director will ensure the play ground equipment is removed to maintain 6ft special requirement is met. Children will not be allowed access to equipment until proper spacing is complete.
