Inspector Notes

An unannounced monitoring inspection was initiated on 10/15/2024 and completed on 10/15/2024 with a local agency in response to a self-report received by the licensing office on 10/09/2024 relating to forbidden actions. The inspector reviewed 1 child's record and 1 staff record on-site.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program. Though not a part of the original self report, violations that were not reported were found related to administration, staff qualifications and training and programs and are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 11/08/2024. A POC submitted after this date will not appear on the public website.

Standard 8VAC20-780-140-A
Each child shall have a physical examination by or under the direction of a physician before the child's attendance or within 30 days after the first day of attendance.

There is no documentation of a physical exam on file for child 1 who has been in care for 12 months.
Plan of Correction: Parents will be informed and reminded to turn in all documents.
Standard 8VAC20-780-240-A
The Virginia Department of Education-sponsored orientation course shall be completed within 90 calendar days of employment.

Staff 1 has not completed The Virginia Department of Education-sponsored orientation course. Staff 1 has been working at the facility for more than 90 days.
Plan of Correction: Staff will get trainings done and be reminded of deadlines. If not done by deadlines will not be allowed back until done.
Standard 8VAC20-780-340-A
When staff are supervising children, they shall always ensure their care, protection, and guidance.

On October 8, 2024, child #2 ( age 44 months) was restrained in a highchair with no meal, no activity, toy or attention by staff #1 for approximately 33 minutes. Staff #1 states she routinely places child #2 in a highchair due to his disruption, and she did not know of any other way to keep him from misbehaving.
Plan of Correction: All staff have been counseled on behaviors and behavior management. Director will work more closely with staff in specific areas.
Standard 8VAC20-780-340-D
In each grouping of children at least one staff member who meets the qualifications of a program leader or program director shall be regularly present.

Staff #1, the only staff present in the preschool classroom, on the morning of October 8, 2024, does not have written documentation on file to demonstrate that she meets program leader qualifications.
Plan of Correction: Director will ensure all new staff begin work only after turning in all paperwork.
Standard 8VAC20-780-400-A
In order to promote the child's emotional, and social well-being and growth, staff shall interact with the child and one another to provide needed help, comfort, support.

When the inspector entered the facility on October 15, 2024 at approximately 11:00 am, staff 3 was speaking to children, in one preschool classroom, using a tone of voice that was irritated, negative and did not provide comfort to the children or positive re-direction.
Plan of Correction: Staff 3 has been retrained on word choice and tone. Has also done trainings on child interaction and reframing negative thoughts. Will continue to be monitored.
Standard 8VAC20-780-410-1
The following actions are forbidden: Roughly handling a child.

On October 8, 2024, staff #1 picked up child #1 ( age 3 years) by the lower part of her left arm and her feet left the floor. Child #1 was crying and injured. As a result, child #1 required medical attention at the Emergency Room.
Plan of Correction: Staff 1 is no longer employed as of October 8, 2024.
All staff have been retrained on forbidden actions and handling of children. Staff will continue to get reminders.
Standard 8VAC20-780-410-2
The following actions are forbidden: Enclosure in a space that the child cannot freely exit himself.

On October 8, 2024, Child #2 ( age 44 months) was restrained in a highchair for approximately 33 minutes not during mealtime.
Plan of Correction: Highchair was removed from classroom.
