During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.
Inspector Notes
An unannounced, on-site monitoring inspection was initiated and completed on 5/22/2025, as a part of the licensure period. The on-site inspection began at 10:25am and ended at 11:40am. The inspector reviewed compliance in the areas listed above. There were 10 children present and 2 caregivers; the point total was 29. The inspector reviewed 5 children?s records and 4 caregiver records on-site.
This inspection included document review, tour of the facility, interviews, and observations. Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.
Standard 22.1-289.035-B-1
The family day home is required to obtain a completed sworn statement prior to the employee's first day of employment. The sworn statements for Caregiver #3 and Caregiver #4 were dated after their first day of employment.
Plan of Correction: Provider will ensure sworn statements are completed before the employee's first day.
Standard 22.1-289.035-B-2
Providers must obtain a completed national criminal background check prior to the employee's first day of employment. The national criminal background check in the record for Caregiver #3 was obtained a month after the employee's first date of employment. The national criminal background check in the record for Caregiver #4 was obtained two months after the employee's first date of employment.
Plan of Correction: Provider will ensure the national criminal background check results are received before the employee's first day.
Standard 22.1-289.035-B-3
The family day home must request a search of the central registry prior to the employee's first day of employment. Caregiver #3, who had been employed for two weeks, did not have a central registry search requested. Caregiver #3 does not work in the family day home, but has worked ?a few times? since beginning employment two months ago. The central registry search results for Caregiver #4 was obtained two months after beginning employment.
Plan of Correction: Provider will ensure requests for a search of the central registry are completed before the employee's first day.
Standard 8VAC20-800-120-B
Providers must maintain a record for each caregiver which includes all required information. The record for Caregiver #3 did not contain the date of employment and documentation that two or more references as to character and reputation as well as competency were checked before employment. The record for Caregiver #4 did not contain the date of employment. Caregiver #4 has been employed for approximately two months. One reference obtained for Caregiver #4 was not dated as required.
Plan of Correction: Provider will ensure dates of employment are documented in caregiver records.
Standard 8VAC20-800-510-C
Occupied cribs shall be atleast 12 inches from each other. Two occupied cribs were observed side by side, closer than 12 inches apart. The children, one in each crib, were holding hands.
Plan of Correction: Provider separated the cribs during the inspection.

Infants and toddlers shall spend no more than 30 minutes of consecutive time during waking hours confined in a crib. 6 children were observed awake in cribs for 55 consecutive minutes.
Plan of Correction: Provider removed the children from their cribs during inspection.
Standard 8VAC20-800-800-B
The provider is required to review the emergency plan at least annually and update the plan as needed. The provider is required to document in writing each review and update to the emergency plan. The annual review of the emergency plan was overdue by more than three months.
Plan of Correction: Provider will review the emergency plan and update if needed.
Standard 8VAC20-800-90-A
Before attendance, documentation of immunizations is to be obtained for each child.
The documentation of immunizations for child #3 was overdue by three days.
Plan of Correction: Provider will ensure immunizations are obtained before the child's first day.
