Any employee of a registered, and approved facility who is involved in the day-to-day operations or who is alone with, in control of, or supervising one or more children shall have a completed and signed sworn disclosure statement or affirmation.
The vendor/provider did not have a signed sworn disclosure statement for herself.

Repeat violation
The vendor shall ensure that the family day home does not exceed the capacity of children cared for as allowed by law or regulation.
Upon arrival at 9:20 AM, there were nine children in care in the child care room with the vendor and one other adult.

The vendor shall maintain a written hard copy record of daily attendance that documents the arrival and departure of each child in care as it occurs.

Vendors shall maintain, and keep at the family day home, written or electronic information for each enrolled child.
The vendor did not have a record for child 4 in care during the inspection.
There were records provided for only three of the nine children in care at the start of the inspection.

Records shall be kept for each caregiver.
There were no records available for staff 3, 4 and 5 who were listed on the signed parent agreements as back-up providers in the absence of the vendor/provider.

Vendor records shall include documentation that training required by 8VAC20-790-250 has been completed that includes the name and topic of the training, the date completed, the total hours of the session, and the names of the organization that sponsored the training and of the trainer.
The vendor was unable to provider documentation that the vendor completed the Virginia Pre-Service Training for Child Care Staff.

Areas and equipment of the family day home, inside and outside, shall be maintained in a clean, safe, and operable condition. Unsafe conditions shall include splintered, cracked, or otherwise deteriorating wood; chipped or peeling paint; visible cracks, bending or warping, rusting, or breakage of any equipment; head entrapment hazards; protruding nails, bolts, or other components that entangle clothing or skin; the presence of poisonous plants; tripping hazards; and unstable heavy equipment, furniture, or other items that a child could pull down on himself.
There is a top-loading freezer without a child proof latch in the accessible dining room.
There is a front loading freezer and a front loading dryer without child proof latches in the laundry room through which children pass to access the bathroom.
There is a 3 and 1/2 foot tall fan propped and leaning over within reach of the children that could topple upon a child.
There were dangling electrical cords hanging from the wall-mounted television.
Three of five high chairs that the vendor confirmed are used for the children do not have the required seat belt systems.
A wooden tread on the stairway used by the children to access the bathroom has a missing piece that cracked off of the stair tread leaving a jagged edge.
There are plastic grocery bags and single use gloves posing suffocation hazards stored in an unlocked cabinet under the sink in the children's bathroom.
FIve bedrooms do not have child proof latches to keep children from accessing the contents of the rooms.

Radiators, oil and wood burning stoves, floor furnaces, fireplaces, portable electric heaters, and similar heating devices located in areas accessible to children shall have barriers or screens
There is an electric fireplace in the living room that does not have a barrier or screen.

Stairs with three or more risers that do not have protective barriers or guardrails on each side shall not be accessible to children over the age of two years.
There are four stairs that the children climb when accessing the bathroom. These stairs do not have protective barriers or guardrails.

Potentially poisonous substances, materials, and supplies such as, but not limited to, cleaning agents, disinfectants, deodorizers, plant care chemicals, pesticides, and petroleum distillates shall be stored away from food in areas inaccessible to children.
There are cleaning fluids and laundry soaps with warning labels on top of the washer and dryer in the hallway through which the children pass when accessing the bathroom
The following substances with warning labels were found:
- a spray can of cleaning fluid in the unlocked cabinet under the sink in the children's bathroom,
- a spray bottle of kitchen cleaner on the open counter in the kitchen,
- diaper cream on top of the stacked boxes beside the changing table.
- two containers of hand sanitizer on the children's activity table.

In order to promote the child's physical, intellectual, emotional, and social well-being and growth, caregivers shall model desired, appropriate behavior and interact with the child and one another to provide needed help, comfort, and support.
The vendor responded to undesirable behavior of the children by repeatedly saying "sit down", "stop", "cut it out", "I'm not going to keep talking to you", and "no". No help, support or guidance to appropriate behavior was provided. No caregiver directed activities were provided during the inspection.

Repeat violation
The caregiver shall wash their hands with soap and running water before preparing and serving food or beverages.
The vendor/provider did not wash their hands before preparing and serving morning snack.

The diapering surface shall be nonabsorbent.
The vinyl covered changing pad on the diaper changing table is torn and cracked.

Repeat violation
Shelter-in-place procedures shall be practiced twice a year.
There was no documentation that any shelter-in-place drills were conducted in the past year.

Tables shall be cleaned and sanitized before and after each use for feeding.
The table was not cleaned and sanitized before serving the children morning snack.

Food shall be served in a clean and sanitary manner.
No plates or napkins were used when serving the children graham crackers for snack.

Prepared infant formula shall be refrigerated, dated, and labeled with the child's name.
At the start of the inspection, there were three partly filled infant bottles on the table in the child care room. The bottles were not dated nor labeled with a child's name.

Animal litter boxes, toys, food dishes, and water dishes shall be inaccessible to children.
The dog's water and food bowls on the floor of the kitchen were accessible to the children.
