Inspector Notes

An unannounced code compliance inspection for the religiously exempt child day center was conducted on 03/18/2024. A total of 28 children, ages 2 years-5 years and 7 staff were present during the inspection. A total of 5 children?s records and 5 staff records, as well as other required documents were reviewed during the inspection. The children were observed during teacher directed activities and self-directed activities. The inspector arrived at approximately 9:30 am and departed at approximately 11:15 am.

Information gathered during the inspection determined non-compliance with the Code of Virginia and violations were documented on the violation notice issued to the provider.

Based on record review, the center failed to ensure that all employees shall undergo a background check in accordance with the Code of Virginia prior to employment and every five years thereafter.

Evidence:
1. The most recent employment eligibility letter for Staff 2 was dated 06/4/2018. There was no 2023 employment eligibility letter available for review during the inspection. Staff 2 was observed working during the inspection.
2. The most recent employment eligibility letter for Staff 4 was dated 05/10/2018. There was no 2023 employment eligibility letter available for review during the inspection. Staff 4 was observed working during the inspection.
3. The most recent employment eligibility letter for Staff 5 was dated 05/10/2018. There was no 2023 employment eligibility letter available for review during the inspection. Staff 5 was observed working during the inspection.
Plan of Correction: Provider will provide staff with instructions to submit to fingerprinting.

Based on document review and staff interviews, the center failed to ensure that no person shall be hired for compensated employment prior to the facility obtaining an employment eligibility letter upon the completion of a fingerprint background check as required by the Code of Virginia.

Evidence:
1. Staff 6 verified that there was not an eligibility letter for Staff 1 available for review during the inspection. Staff 1 was observed working during the inspection.
2. Staff 6 verified that there was not an eligibility letter for Staff 3 available for review during the inspection. Staff 3 was observed working during the inspection.
Plan of Correction: Provider will provide staff with instructions to submit to fingerprinting.
Standard 22.1-289.049-A
Based on record review and staff interviews, the center failed to ensure that upon enrollment of a child in a regulated child day program, the center shall require that the person enrolling the child presents the program with proof of the child?s identity and age.

Evidence: Staff 6 verified there was no information obtained from person enrolling the child regarding identity and age for Child 1, Child 2, Child 3, Child 4, and Child 5.
Plan of Correction: Provider will obtain from families.
