Inspector Notes

A complaint investigation was conducted beginning 3/30/2023 and concluded 5/1/2023. The complaint consisted of allegations received by the Northern Licensing Office on 3/28/2023 regarding rough handling. Based on staff interviews and review of documentation, a preponderance of evidence supports the allegations regarding rough handling. Therefore, the complaint is determined to be valid. Areas of non-compliance are identified in the Violation Notice.

Based on documentation review and staff interview, it was determined staff engaged in a forbidden action of rough handling.

Evidence: On March 27, 2023 at approximately 10:35am, Child #1 and another child were fighting over a ball on the portico playground. Staff #1 went to intervene and "grabbed and jerked" Child #1 by the hood of their jacket "causing the child to fall backwards and hit their head on the play structure."
Plan of Correction: In response to the violation on March 27, 2023, the staff member was immediately placed on administrative leave (March 27, 2023). The staff member was subsequently terminated. All staff members have been retrained in Positive Guidance and Accountability (April 12, 2023).
