8VAC20-790 Subsidy Regulations

Inspector Notes

A subsidy health and safety inspection (SHSI) was conducted in conjunction with the code compliance inspection. Subsidy standards that are not covered in code were reviewed during this SHSI.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations were documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 12/9/2024. A POC submitted after this date will not appear on the public website.

Standard 8VAC20-790-560-A
**Repeat Violation**
The center is required to obtain documentation of a negative tuberculosis (TB) screening at the time of employment and prior to coming into contact with children.

The record for staff #3, who was employed for over 1 year, did not contain documentation of tuberculosis screening results.
Plan of Correction: Administration will work to ensure we have TB results in hand before new staffs first day at work. Gave staff member the proper paperwork to get screening done asap. Appointment was secured and assessment was completed 11/19/24.
Standard 8VAC20-790-560-B
A tuberculosis (TB) screening is required every two years from the last screening.

Staff #7's updated TB screening was due over 20 days ago. The updated screening has not yet been completed.
Plan of Correction: Administration has a set method to check expiration dates on all required paperwork. We thought TB were done every 5 years. We have updated our policy and Staff #7 made appt with her doctor for 11/24/2024 arrived and doctor did not have proper needles to administer PPD shot. New appt made for 12/5/24.

The vendor shall obtain documentation that each child has received the immunizations required by the State Board of Health before the child can attend the center.

The record for child #2, who was in care for 2 days, did not contain documentation of immunizations.
Plan of Correction: Child #2 first week was the week of inspection and mom does not give immunizations to Child #2. I informed her needed the religious exempt paperwork, and she could not get paperwork signed because she was waiting to receive her new ID that was not expired. Then notary would not sign the paperwork with her expired ID. Paperwork received.

All staff shall have a current certification in cardiopulmonary resuscitation (CPR) within 90 days of the date of employment.

Staff #4, who has been employed for over 7 months, did not have a current certification in cardiopulmonary resuscitation.
Plan of Correction: We were not aware that having subsidy this was a requirement. So, we placed staff #4 in a classroom with a lead teacher who is certified, which was the standard we knew. The date for her class was 11/19/24 after close of business.

All staff shall have a current certification in first aid appropriate to the ages of children in care within 90 days of the date of employment.

**Repeat Violation**
Hazardous substances shall be kept in a locked place using a safe locking method that prevents access by children.

Classroom #1 was observed to have 3 bottles of disinfectant spray located unlocked in the changing area for children. Classroom #3 was observed to have 1 can of disinfectant spray unlocked on the counter near the doorway. The boy?s restroom was observed with all-purpose cleaner and Windex spray unlocked under the sink. The girl?s restroom was observed with bleach and disinfectant spray unlocked under the sink.
Plan of Correction: Staff in the classroom received a verbal reprimand due to being out of compliance and knowing the standard and failing to uphold the standard. Staff was instructed to use the lock box each class was given store chemicals upon completion of diapering times. The locks for the bathroom cabinet were in the office to install man doing the renovations forgot to put them on; added same day.

The provider shall maintain a record of the dates of the practice emergency response drills for one year.

The were no records for practice drills completed during February 2024 through May 2024.
Plan of Correction: Due to renovations in the building our emergency response drills were missed. Administration has made electronic monthly reminders to complete drills.
Standard 8VAC20-790-820-E
Prepared infant formula shall be refrigerated, dated and labeled with the child?s name if more than 1 infant is in care.

During the inspection, 3 bottles with infant milk were observed in the refrigerator without a child?s name or date.
Plan of Correction: Teacher stated she had run out of labels and forgot to ask for more. More labels have been purchased and instructions given to the staff on how to properly label and date all bottles daily. With names and dates and proper labels.
