Inspector Notes

An unannounced joint complaint inspection was conducted with a representative from the local agency and law enforcement on April 5, 2024, from 10:00 a.m. to 2:00 p.m. The complaint was received on April 3, 2024, regarding forbidden action and failure to report suspected abuse and neglect. Interviews were conducted and facility documentation was reviewed. Additional follow up was conducted on April 25, 2024. Based on the information gathered during the inspection, the allegations were determined to be valid.

Based on interviews, the center, having reason to suspect that a child was abused or neglected, failed to report the matter immediately to the local department of the county or city wherein the child resides or wherein the abuse or neglect is believed to have occurred or to the Department's toll-free child abuse and neglect hotline. Evidence: Staff of the center who are all mandated reporters did not report suspected child abuse and neglect immediately as required. Interviews revealed that staff reported concerns of abuse and neglect to management. On March 27, 2024, an incident occurred in which staff witnessed another staff roughly grab and hit a child. As of April 3, 2024, the incident had not been reported.

Based on interviews, it was determined that the center failed to ensure that roughly handling children was forbidden. Evidence: On March 27, 2024, Staff #1 was observed by three staff members roughly handling and physically punishing Child #1, age 4 years, by roughly grabbing him by the arms and hitting him on the arm.
